hello everyone, i need advice/help from u guys.

im on an I-130 F2B petition and waiting for visa availability to be current to get a schedule for an interview at the US embassy. my problem is, my petitioner is being charged of a crime (petitioner is now in jail with a hearing set by the end of the month), all i know is that she's being charged of taking money from her boss' bank account using cheques. no prior convictions of any sort just this one case pending in the courts. will this in any way delay or affect my petition?

It depends how grave of a crime she is being charged with. If there is a chance of her being deported then yes, that will affect your visa.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

i dont think that she'll get deported because of this case.. btw, she is now an american citizen. any thoughts? if ever she doesn't get deported will this still affect my petition?

If she can still prove the financial support, I doubt it'll have a major impact, unless there is a lengthy jail sentence.

how many years is a lenghty jail term? if ever she does get convicted and gets somewhere between 1 to 5 years jail sentence, obviously she cant be around for financial support, will that be an issue? what should i do next to remedy this?

dont move this coz even though my petitioner is now an american citizen, my petition is still under the F2B category so technically this is still my section. right?

The answer to your question is different because your petitioner is a USC.

yes true she's a USC, but my petition still falls under F2B and i have a letter approved by the embassy that says im still on F2B even if my petitioner has naturalized. although my petitioner's circumstances have changed my petition is still considered F2B and not F1
