The perceived lack of (at minimum) legal temperament in unquoted verbiage visible under your username in this thread is rather indicative of the applicable professional status that has been suggested just above. Also, the spelling is atrocious. Finally, sometimes new members don't know what they don't know.

You said "you admit that you're not a lawyer". Where was that?

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Yes I did on the first page . I am just confused now with the new I129F form . I had a question 11 attached sheet which no longer seems to be needed in the new form . Also question 18 is now 34a which I will just make a new one with the correct number . Should I try to find the I129F dated to when I used it ? Actually getting an RFE which I was upset about at first is turning to out to be good . I would imagine this will delay the decision , but we need the time anyway .

Just update been 8 days still no hard copy of the RFE . I called today and they said " Oh I see you called about this before " I was like do they take notes ??? Guess so :)

Yes, the form is a bit different now. If you still have the old form saved, you can just use it and simply add the child on it and add your explanation letter. The older edition you used is still accepted until mid Sept.

1. If I were in your shoes, I'd prepare drafts of what you plan to say or add, but not fill out any forms themselves just yet. Wait to see the RFE instructions.

2. It could take another week, or even longer, for the hard-copy RFE to reach you. That's actually good, because it gives you additional time to flesh out and massage the drafts of what you plan to say. And yes, USCIS notes the topics of calls (at least the good representatives do). smile.png

I wish that more folks here would adopt your mature view in regard to receiving an RFE.

At first I hit panic mode , but then saw the opportunity of my situation . We have to wait longer , but at least the 3 of us would be flying home together . This way the baby will be a wee bit older when flying .

If the new I-129F form is confusing or more difficult, you can still use the previous form until September 16, 2013:

"Edition Date :The current edition is dated 06/13/13. (USCIS will accept editions dated 06/22/12, 11/23/10, 06/14/10, and 02/19/10 until September 16, 2013. After September 16, 2013, we will only accept the 06/13/13 edition.)"

I do believe it was originally stated here to fill out an I-129F with the RFE

Whatever form asks to list all children, send in an updated form with explanation letter....along with any RFE documentation you have to send.


I mentioned the same several times as well as followed up with advice from the very reliable JayKay in the beginning of the post.

The legalities of custody I also mentioned in the beginning of the post:

If I remember correctly the K1 will cover the stepchildren if they're put on the petition, due to a recent change on how the K1 operates. I am not 100% sure though and you'll need to check.

As for the laws regarding taking the infant from the country a quote from a legal source:
By law and jurisprudence, the mother of an illegitimate child has sole parental authority and is entitled to keep the child in her company. This rule continues to apply even when the father of the child acknowledges filiation (paternity), although the court may order the father to provide support as a result of the acknowledgment, but not custody.

I want to say, that I understand the desire to defend your position especially if you feel that it's right, but people are coming here for guidance and support during a very trying and confusing process. Gods know we've all been freaking out at one point, or unsure of how to handle a certain circumstance. It's crucial to these people's success that you clearly and concisely answer their questions, and if you want to throw an opinion in the mix, please keep it cordial, neutral and state thus. The K1 forum is not titled "legal debates", nor is it anyone's personal punching bag. There are other forums which encourage debates, and ranting -- please make use of those.

If the new I-129F form is confusing or more difficult, you can still use the previous form until September 16, 2013:

"Edition Date :The current edition is dated 06/13/13. (USCIS will accept editions dated 06/22/12, 11/23/10, 06/14/10, and 02/19/10 until September 16, 2013. After September 16, 2013, we will only accept the 06/13/13 edition.)"

I have one dated 06/30/12 , but which has the date 06/22/12 at the bottom . The dates you stated are the ones at the bottom ?
