My new wife with her 2 children (ages 11 and 9 yrs) are with us together finally.

Here's what I think the total cost for AOS would be:

I-485 (Appl. for Perm. Resident) $985 + biometrics fee of $85.00 for a total $1070.00 Since the kids are included and are under 14, therefore no fee and no biometrics for them.

I-765 (EAD) $380.00 x 3 = $1140.00

I-693 (Report of Medical) = No fee.

I-131 (Travel/Advance Parole) $360 x 4 = $1440.00

So the total comes out to $3,650.00. Do I have it right? It seems high, but they all are feeling homesick already.

Any inputs will be highly appreciated. Thanks in advance.

For your wife, the EAD and AP are free when you are applying for AOS. For your wife the fee is $1070.00 for AOS, EAD and AP.

Nope you're totally wrong (and you should be happy about that!!). First her kids DO have to pay for AOS (not the full fee) but they don't need biometrics. There is also NO FEE for the EAD or AP. Remember to put c9 as the category on the EAD.

There are exceptions in which the applicant is not required to pay the entire $1070:

  • Applicants 79 years of age or older are not charged a biometric fee; the fee total is $985.
  • There is no fee for applicants who are filing Form I-485 based on having been admitted to the United States as a refugee.
  • There is no fee if an applicant is filing as a refugee under section 209(a) of the INA.
  • For applicants under 14 years of age:
    • Filing with the I-485 application of at least one parent have a fee total of $635;
    • Not filing with the I-485 application of at least one parent have a fee total of $985.

Please note that, if you file Form I-485 to adjust your status as a permanent resident on or after July 30, 2007, no additional fee is required to also file an application for employment authorization on Form I-765 and/or advance parole on Form I-131. You may file these forms together.

For AOS it's as follows:

Wife: $1070

11 yo: $635 (because they're filing with their mum)

9 yo: $635 (because they're filing with their mum)

So the TOTAL fee you need to pay is: $2,340.00 that's it.

Hehehe....Guaranteed USCIS will not give back any extra fees sent to them....or do they?. This site is really helpful!

If you filed something you weren't eligible for but they issued you a receipt, then they keep the money and deny you once they realise you're not eligible.

if you had overpaid for this AOS they would have most likely rejected the entire packet telling you the fee is wrong. They cannot accept overpayments (or underpayments).
