The funny thing is, as much as I rant about the differences between us, when the cops ask to look around my car, I always comply because I don't anything to hide. It's not worth the hassle IMO.

Still wouldn't have a problem with it. Every club we go to, I get frisked. Nothing new here. Plus I have nothing incriminating on me so it's not really an issue for me.

The only reason blacks and hispanics have a problem with SAF is because they target us exclusively during the daylight hours between 8 and 4. They won't SAF drug dealers or gang members, but the 14-40 year old going to school or the young business men going to work.

Then I would respectfully tell them to kiss my a**.

I had a Commander in the Navy a few weeks ago ask me to beat box into a microphone. I looked at him like he was crazy.

Any club that has a majority of black people that go to it, you can expect it. Last place we went was the Signature club, my boss invited us since she told us it has a mixed crowd. Yeah right, there were two white women there, that's the mixed crowd. I had on a nice suit jacket and outfit on, so it was a surprise that I didn't get frisked. My wife was nervous, but I explained to her that this was an older crowd with gator shoes and white hats, they dressed up too nice to be fighting.

I bet your husband would never give up a parking space, simply because a cop asked him to move. I know I wouldn't. Only someone with a distinct fear of the po po would do that.

Yes, an a-hole cop blocked me in but it wasn't a law enforcement stop and while engaging in the privilege of driving on public roads, it's extremely difficult to claim rights to anything, especially when that person is already occupying the space through which you must move. Had it been a private citizen and not a cop I still would've had to move. I wouldn't have been as concerned about getting shot, but I still wouldn't have been able to "stand my ground" while every car behind that car backed up just to let me get in the space.

It is in the Jeep for a reason. However, I wasn't in the Jeep nor was I armed.

let's not pretend that allowing them to take five minutes and look into your house is giving up some kind of freedom.

So if everyone has nothing to hide and allows law enforcement to take five minutes and look around, wouldn't it seem kind of strange and/or suspicious when someone calmly said no?

See, the thing about the 4th Amendment is it's not supposed to only be used in a court of law. It's supposed to be the default. Cops should not be looking through our homes or automobiles or whatever. They should have to ask nicely and when we say no, they should have a huge burden placed upon them. The only time they should be bothering anyone is when they're absolutely positively sure there's criminal activity going on.

Problem with the current situation is everyone just says, "Well, it's easier to just let them search through my stuff. I have nothing to hide." On a long enough timeline, that turns into, "As I was conducting a routine patrol, a citizen would not allow me to search their home so I knew they had something to hide."

Don't believe me? Try going through the airport. What started off as a "common sense, good idea for everyone's safety" ended up taking away the privacy of everyone. Same thing is happening when it comes to law enforcement searches. And it all starts with setting the legal precedent of, "It's no problem to waive my rights."

Not necessarily. Police are supposed to have first-hand knowledge of a situation before tossing out someone's rights to privacy. They can investigate the situation but something like a call from next door doesn't automatically give them probable cause for a search. If they were standing there talking to the tenant and heard a cry for help or they arrived on scene and heard a loud argument in progress, maybe. But a call from next door to 911? Not enough.

The police were called to an argument between a man and a woman, aka a domestic disturbance. When the cops arrived on the scene only one of the participants of the argument, the man, was present. The cops cannot leave the scene without assuring that the woman is ok. A compliaint over the phone doesnt give police the right to enter a home. This is exactly why we have a 4th Amendment. Saying no doesnt give them the right to arrest you either. Situations such as these are exactly why we have rights and cops must get warrants.

It depends what the complaint is. A loud stereo, no. Domestic disturbance, most definitely. The only thing a cop needs to enter your house is reasonable suspicion, a 911 domestic call fits that bill. And even if reasonable suspicion doesn't exist, a cop can "think' he heard something from inside your house.

saying no doesn't give them the right to arrest you, but it does piss them off and where i'm from, they'll be more bound and determined to get a warrant and into your house, even if it's just to tear up all your stuff. true story.

These wanna be American Heroes crack me up. Any Cop would have a field day with someone like slim. My brother tells me about these clowns all the time. They get all chest pumpin with the cops telling them about their constitutional rights. And then they happen to fall down the stairs and bang their heads on their way to booking. laughing.gif

did you know couch cushions and curtains must be cut open, in order to make sure they're not stuffed with cocaine or bath salts? all drawers and contents must be emptied out on the floor and cops cannot be bothered to step over their piles - they must step wherever their feet land. and good luck suing for damages. unless your independantly wealthy to begin with.

Not true.

Cops must have first-hand knowledge of someone in danger in order to trump your 4th Amendment rights. A domestic call from a neighbor isnt enough. A call from inside the home may be.

Fine. Theyve followed the law.

There will be less of this as it gets more difficult for them to do it.
