hi im youngdaddy from texas... i am soooo sad!

i feel envy with people here announcing their petitions getting approved left and right as someone said that line... u guys are so lucky.

im a permanent resident here. i arrived here 4 months ago.. and ive been missing my girlfriend and kids so bad. we are not married and i cant figure out how to petition them.. pls help me.

i am visiting philippines next year and i wonder if im marrying her then file a petition when i get back here? or is it advisable i wait for me to be US citizen then marry her and petition them which is 5 years from now... i dont know which way to go. which one is faster? im longing for them everyday... i got two boys thats waitin for me to play with them. im like a kid crying all the time.

i didnt marry her because of this visa i needed to stay single. that was my case...im sure someone does too.

im not sure if this is the right room... but i need to let it out.

Not sure this will help, but I am no immigrations lawyer. Try this website TheFilipino you may want to consult an immigrations lawyer. It might help other members here if you let them know what kind of Visa you entered the U.S. on. Ken & Maria

26 Dec 06 - Received Packet 4

18-19 Jan 07 - Medical complete early, scheduled 8 Feb

19 Jan - CFO completed after SLE shots... have to go back for the stamp after visa approval

15 Feb 07 - Interview Approved

24 Feb 07 - Arrive at Honolulu POE

2 Apr 07 - Married, civil ceremony, mailed AOS

17 Apr 07 - Checks cashed for AOS & AP

22 Apr 07 - Filed Expedite for AP

8 May 07 - Biometrics Appt

8 May 07 - Filed complaint with local USCIS for no action on Expedite request

9 May 07 - AP Expedite approved via email

14 May 07 - received AP I-512L documents in the mail

25 Jun 07 - AOS Interview scheduled but cancelled due to deployment and family emergency

29 Nov 07 - Visited local USCIS to reschedule AOS interview

15 Jan 08 - Local USCIS finally forwards reschedule request after formal complaint

8 Feb 08 - Received new Interview date

28 Mar 08 - AOS Interview ..investigation reopened due to incorrect birthdate that was identified 05/07

16 Apr 08 - CRIS Notice of GC approval and welcome notice via email

25 Apr 08 - GC received finally!

15 Jan 10 - Mailed Lifting of Conditions Package

19 Jan 10 - Package received at VT USCIS

22 Jan 10 - Checked cashed by USCIS

26 Jan 10 - Received NOA dated 20 Jan 10

You can get married and petition for your wife whilst you are an LPR. But you can only file an I-130, which when approved and a visa number comes up, she will be able to apply for an immigrant visa. When you gain citizenship your petition can be upgraded to that of a USC and there will then be no visa number to wait for as spouses of a USC are immediate. (Not immediate in the true sense of the word though as you still have to wait for an interview to be scheduled and the time frame for this various from consulate to consulate).

You have to become a citizen first and then apply for her and your kid.

For the avoidance of confusion, he has to become a citizen in order to petition for a K visa. He does not need to become a citizen to petition for immigrant visas for his (future) wife and child (although the wait will be shorter if he is a citizen).

RIGHT! SO HERE'S WHATS ON MY MIND... IM GOING BACK THERE NEXT YEAR AND MARRY HER. ONCE I GET BACK USA, APPLY THE PETITION AS SHE IS MY SPOUSE ALREADY TOGETHER WITH THE KIDS. THEN IF I BECOME US CITIZEN, UPGRADE THE PETITION! CORRECT????
