Hi everyone,

My simplified understanding of DCF:

  1. Send i130 packet
  2. Send DS-230 packet
  3. Send "packet 3"
  4. Interview

My question is, when during this process is one supposed to provide proof of the (spousal) relationship? All the instructions I've read (for Frankfurt, particularly http://germany.usembassy.gov/visa/files/i130_instructions.pdf) don't ask for any sort of joint tenancy lease, photographs, etc. to be submitted with steps 1-3 or to be brought to the interview. Am I missing something? Should I be preparing a photo album and copy of my lease now to send with the i130 package?

2013-11-04 DS-260 resubmitted with addition of US permanent address

2013-11-05 Immigrant visa document package (packet 3) mailed

2013-11-15 Letter with interview date received in the mail. Interview date WAY too short notice to get medical done in time

2013-11-18 Emergency trip to Frankfurt to get medical done

2013-11-19 Walk-in medical in Frankfurt (limited walk-in hours, so couldn't do day before interview)

2013-11-19 Finally get email response from consulate saying it's OK to get the medical done after the interview (too late)

2013-11-21 Interview in Frankfurt

2013-11-26 Visa received. Woohoo!

2013-12-24 POE Seattle - they were confused by lack of paper DS-230

2014-02-08 Green card arrived in the mail

2014 Social security card never arrived - got one at local SS office

It's in the actual I-130 instructions that you supply that information with the I-130.

Thanks for the quick reply. In the meantime I found a different Frankfurt-specific checklist (http://photos.state.gov/libraries/frankfurt/9318/consular_pdf/I130%20Instructions%20and%20Checklist.pdf) that does tell you to submit some evidence: "...you may also wish to submit additional evidence related to the bona fides of the marriage...."

It appears to vary by country. Other than our marriage certificate, we provided zero relationship evidence to London. London expressly asks for certain documents, and relationship evidences are not included.

Does Frankfurt provide a document checklist?

* I-130/CR-1 visa by Direct Consular Filing in London
3rd May 2013 - Married in London

7th May 2013 - I-130 filed
4th June 2013 - NOA2 (approved)
16th July 2013 - Interview (approved)
30th July 2013 - POE San Francisco
29th August 2013 - 2 year green card arrived

* Removal of Conditions (RoC) via California Service Centre
1st May 2015 - 90 day RoC window opened
6th May 2015 - I-751 filed (delivered 8th May, cheque cashed 18th May)
7th August 2015 - Approved / GC production

27th August 2015 - 10 year green card arrived

* Naturalisation (Citizenship) via Phoenix Lockbox

* San Francisco Field Office:
1st May 2016 - N-400 window opened
20th August 2016 - N-400 filed

26th August 2016 - NOA1
13th September 2016 - Biometrics

12th January 2017 - Biometrics (again)
30th May 2017 - Interview (approved)
7th June 2017 - Oath

Never- unless they ask for it (in London anyway).

One of the many advantages of DCF. Go by the DCF checklist and send what they ask for.

CR1 / DCF (London): 2012 / 2013 (4 months from I-130 petition to visa in hand)

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

Trouble is, there are two checklists that I've found online. One doesn't mention evidence at all (http://germany.usembassy.gov/visa/files/i130_instructions.pdf). The other (http://photos.state.gov/libraries/frankfurt/9318/consular_pdf/I130%20Instructions%20and%20Checklist.pdf) indicates that it's optional.

It was not necessary to submit any evidence beyond the marriage certificate (and in the case of our sons, birth certificates) when doing DCF through the London Embassy but I see it must vary according to each Embassy. Since you have found two different sets of instructions, I would advise sending the optional documentation. If they don't need it then no harm has been done in sending it but it is better to err on the side of caution just in case they do require it.

As a family of six, we relocated from Argyll in Scotland to Pennsylvania in October 2013. 

I applied for Citizenship in October 2017 and am currently waiting for an Interview date.
