Yes the punishment is different based on the intent, but the punishment does not change based on the race, or sexual orientation of the victim. And why should it? Why should one victims life be deemed more valuable based on their race or sexual orientation? Isn't that exactly what racism and prejudice is?

Because you're dangerous to all gay or black people if you kill someone for being gay or black until rehabilitated. If you kill someone because they slept with your life, you're probably no longer a threat to society. Granted, you still need to be punished.

So the level of punishment should be different in these cases, or the level of rehabilitation should be different?

If a Middle Eastern looking guy showed up at an airport security checkpoint in 2000 with a box cutter, no one would have thought anything about it. Now if a Middle Eastern looking guy shows up at an airport security checkpoint with a box cutter, it probably raises some eyebrows. Is that racial profiling?

Yes.

You know, I don't get off on the whole making people pay stuff. To me the sentence is over when the person is no longer likely to do the crime for which they were sentenced. Now I don't mean to make light of the obvious limitations there are to actually root causing and "fixing" all people sentenced to jail but we must not lose sight of this being the entire purpose. I think we're far to content with using jails to write people off and get them out of society so to speak.

I'll do you one better, guy walks into a school with a bunch of weapons and you know the rest. A month later, a guy walks into a JC Pennys with an AR-15 strapped on his back. Do you think a black man or middle eastern man could have done the same thing?

But yes that is racial profiling. It's the reason muslims in full gear have problems getting flights.

Anytime you have an all white jury, and the victim is black/brown, chances are you're going to have problems. That's one of the stigmas of being black, you will be on trial for your own murder.

Everyone profiles to some extent. I chuckle when someone says they don't.

I can respect that. I do believe that anyone guilty of a crime should be punished for that crime. I don't however believe that the punishment of the same crime should be different for the perpetrator based on the race, or sexual orientation of the victim. That's racism and prejudice in their purest forms.
