Hi all,

In advance, apologies if this is a repeated question. I cant seem to find anything related to my questions. Hope you guys can help me!

A brief history of my Situation:

  • Came to US on L1B, sponsored by current company.
  • Currently L1B Visa, expiring in Jan 2014, however company now renewing for the first time.

My question:

My fiance and I are planning to get married soon (no dates yet as to our current situation). My questions are as below.

  1. Can I still work under L1B visa after getting married (I think I saw some forum says yes, some say no) without applying for AOS? (After my L1B has been renewed)
  2. If I do apply for AOS:
    1. How much will it cost (since I am already on L1B, I read somewhere it may be cheaper),
    2. How long will it take to process of AOS,
    3. Can I still work for my current company in the process of AOS
    4. Should my current company be informed of my intention/process of AOS?
  3. If I do go for AOS after L1B renewal, do i need to wait for a few months before applying for AOS? I read somewhere that it might be a problem as USCIS might take it as an AOS fraud...or is it OK because I have already been in the country for nearly 3 years now.
  4. Since I am under L1B, do I still need to get biometrics (already done that for first L1B visa)? Will this then lower the cost for AOS?

Day 16 - Oct 16 2014 : Received Biometrics Appointment letter (10/30/2014)

Day 30 - Oct 30 2014 : Biometrics done

Day 80 - Dec 19 2014 : Received Interview Appointment via email (01/22/2015)

Day 82 - Dec 22 2014 : Received Interview Appointment in the mail (01/22/2015)

Day 113 - Jan 22 2015 : Interview at 7:30AM and was approved on the same day, received notification via email/text that application approved.

Day 118 - Jan 28 2015 : Received notification that Green Card has been mailed.

Day 120 - Jan 30 2015 : Received Green Card in the mail.

Day 00 - Nov 02 2016 : Submitted I-751 via UPS

Day 03 - Nov 05 2016 : USPS confirm delivery

Day 05 - Nov 07 2016 : NOA receipt date

Day 10 - Nov 12 2016 : NOA received in mail

Day 18 - Nov 20 2016 : Biometrics notice date

Day 88 - Feb 04 2020 Interview and Test (8:00 AM) 😃 (approved on the spot! Waiting for Oath Ceremony Date)

Day 89 - Feb 05 2020 : Had to take photo and finger prints again as system was down during interview and test (7:15 AM at same location as interview).

Day 89 - Feb 05 2020 : Received email and text from USCIS that Oath Ceremony date/time/location details has been mailed out.

Day 110 - Feb 26 2020 : Oath Ceremony (8:00 AM)!  🎉🎊🇺🇸 - Registered to vote + applied for U.S Passport!

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

1. Yes.

2.a. It's the same price for everyone. $420 + $1070 + medical (usually around $200).

b. Depends, usually 3-6 months.

c. Yes.

d. If you want.

3. No. L1 is dual intent so it doesn't matter.

4. You still need biometrics and you have to pay. No lower cost. Same price for everyone. Your being on L1 does not give you any special monetary privileges. The only privilege you will have is that you can continue to exit and reenter the US while AOS is processing.

If I do go for AOS, does it mean that I will get a GC? Do I also need to apply for EAD to be able to work once my L1B has expired?

Adjustment of status is to go from L1 (in your case) to a Greencard because of your marriage to a US Citizen. Spouses of USCs don't live in the US on visas; they live in the US as Greencard holders (permanent residents). You can apply for an EAD if you like with your AOS; it's free. But as long as your L1 is valid you can still work. If it's valid until 201 and you are renewing now, it sounds like you are good on the work front.
