Complications with I-485,I-171,&I-765

Hi

Well i will try and make this as simple as possible. Basically i have three applications pending right now.

The first is I-485...i sent this and i received an RFE...which required written proof that a immigrant visa had been filed on my behalf, such as an I-171 (Notice of Approval From the Consular Office).

Unfortunately i did not have this form, so i had to file an I-824 (application for action on an approved application/petition). The problem here is that i had 87 days to send USCIS the RFE otherwise the case would result in a denial, im still waiting for the information and it is now passed that date. My husband is going to try to speed up the process with writing to the congresswoman in our area for the I-824.

Im going to call USCIS tommorow to explain and try to get some help in regards on how to prepare for the denial i.e. appeal.

The other problem is that i also filed an I-765 form (employment authorisation) and it is now past the 90 days, so they say to contact USCIS which i plan too. I have called them before and they havent really been that helpful. Last time i called in regards to the fact that i had changed my address and only recieved notification for one application and not the other when both applications were sent together. The representative informed me not to worry and that i should recieve notification of my address change for the other application soon.

Months later, still nothing?

It all just seems like such a mess and im trying to be calm and organise everything so im prepared, so hopefully someone here will be able to give me some practical advice.

Why did you not have the proof of an immigrant visa being filed?

married Dec '03 in US

6/13/07 Transferred back to Missouri....grrrrrrr

7/23/07 Interview date! FINALLY!

7/23/07 AOS APPROVED!!! :o) 10 yr Greencard I 551 stamp in passport.

7/28/07 Welcome letter received

7/28/07 Card production ordered.

8/1/07 Approval notice senT

8/3/07 Greencards received in mail!

Hi

I did have proof...just not the required proof they wanted...they are very specific about what they consider proof..i did not keep the letter that was sent to us originally saying (basically) you have been approved to file for a K-1 Visa. They wouldnt even accept a print out of their own website which clearly states the case number and that it has been approved etc.

ahhhhh....OK....I'm sorry....I was thinking you had to have filed...or be concurrently filing an I-130.
