Hello,

I applied for three family members as an i130 (US Citizen filing for married son or daughter)

The only papers I reciecved were the i797 and was approved. Never got anymore papers because it was the wrong address and i just found out today.

Now, all the application were updated June 30, 2010. (I applied exactly September 20, 2005.) Now checking all cases they have been under initial review since 2010 I'm guessing. I just need some help to find out what's wrong.

When I mean wrong address, I mean that it was a family members and he did not reviving anything because my name was not on his mailbox. Would the post office still carry the letters in which were not given?

Thanks,

Will

P.S Sorry if its in wrong section, I'm in a hurry.

I've always used I-865 (though I've never filed I-864) to change my address as petitioner with USCIS. In couple of weeks I'd get a letter saying my case was updated with USCIS - petitioner change of address.

If petitions you filed for were approved, they could've end up in storage until such time that has the case type immigration numbers available. You may want to check on travel.state.gov under visa bulletin what cases they're processing now (dates) in the F3 category you filed for. Looks like you're about three years out - they're processing cases filed by December 08 2002 (except for Mexico '93 and Philippines '92).

Good luck.

So basically around another three years?

But why does it show inital review under usics?

because the petition isn't at USCIS anymore. there won't be any updates at the website. the approved i130 was sent to the NVC or national visa center and filed (stored) until the priority date becomes current.

on the uscis website that's the only information you will get, once the i130 has been approved, no new news will be on it.

the NVC will contact your petitioner (mom or dad) when there is a visa available. for now you have to check the visa bulletin every month to find out what are the dates that immigration Is working on.

as stated your category is F3, meaning married child of a USC,

Thanks for the reply!

Yeah I'm understanding that it has moved locations but how do I know this? Why does it show as initial review? Shouldn't it say that it's approved? And be on the very last bubble?

Have the case numbers? Call up USCIS or even make an infopass and ask what's going on. Sounds like that past the 1st Notice of Action when they received your petitions you haven't received approval notice.
And definitely file I-865 for all cases - it may get you some movement if still with USCIS. I remember receiving email from NVC saying your case is here but since visa is not available we'll just hold it for a while.

So yeah ill definitely file I-865 for all cases. So do you suggest changing address online or physically calling them?

I will call later and ask what's going on. I have approval of all three cases but after that, no clue what's happened. Only know they were all updated 5 years later June 2010. From then on, they stopped.

Also is there any way to expedite the process because of the country they are in and what's going on? (Syria)

For married son or daughter (F3), the priority date is at 2002, so you still have around 3 years to go. You can't expedite to get a different priority date, unfortunately.

So 3 years to be exact?

Could be faster, or slower. The bulletin changes based on how many people are applying when their dates are current and how many visa numbers are available. If they really need out I'd look for another method in the meantime. Good luck.

I-865 is paper form. You get it off of uscis.gov (under forms) fill it out and send it in. Confirmation letter will come to the address you provide where you live now. Always stay on top of this - if you move, change the address with USCIS as well.
