Dear all,

...hopefully you can offer advise and share your experience.
We filed our K-1 application on June 24th and have not yet received NOA1 (it's been almost a month). We contacted our lawyer who said she hasn't 'seen the filing fee check clear the bank yet, but we should be seeing it go through soon, along with receiving the receipt notices'. She also mentioned about current backlogs and that many applications are being trasfered to the Texas Center...

Is this time too long of a wait for a NOA1?! Should we call the Center and check up or give it a little more time?!

Everywhere I've read on this forum for the wait time for NOA1 has been less than a month for sure...

So this means you filed even after what our lawyer supposingly did and got it within 3 weeks.
We have such a bad experience with this lawyer already... I'm not sure if we should call the center for comfirmation or just pressure the lawyer. I am concerned because they are stating that there are new I-129 forms and if it might be an issue. Our application was ready in april, but the lawyer 'FORGOT' to send it!!!


That's what I thought as well... No matter the hold ups, it can't be that it takes them over a month to receive an application and to withdrawn the money...

This would make me wonder if your lawyer wasn't slow in getting it sent in. The package is received at the Texas Lock box where they open them, make sure the basics are there, remove the payment and get the petition ready to send off to whichever service center it is going to. Cashing the check is the FIRST thing they do and should have cleared within a week of your petition arriving.

February 8, 2013 - NOA1 Notice Date May 12, 2014 - Biometrics Appointment Done September 27, 2016 - ROC Approved (Checked status via website w/receipt #)

February 11, 2013 - Bank shows check cashed today May 15, 2014 - Interview Schedule Letter (received May 17, 2014) October 6, 2016 - Card Arrived

February 11, 2013 - E-Mail Notification of Case Acceptance and June 5, 2014 - Interview Scheduled at Local office 8:15 a.m.

We filed our K-1 application

I am concerned because they are stating that there are new I-129 forms and if it might be an issue. Our application was ready in april, but the lawyer 'FORGOT' to send it!!!


That's what I thought as well... No matter the hold ups, it can't be that it takes them over a month to receive an application and to withdrawn the money...

Just a couple of corrections on semantics. What was filed was a petition, not an application. The petition form that was filed was I-129F, not I-129.

Our journey:

I've heard a lot of horror stories with lawyers. I would certainly follow up with both USCIS and the lawyer! From what I have seen everything has been about a week-two weeks for NOA1 from the date of submission. Good Luck!!

Thank you for your answers and advises, at this point they mean a lot!

Yeah, it's been a horror for real... I just don't understand how can 'professionals' working on delicate matters like this be so irresponsible - not just professionally, but personally as well. Instead of taking pride and satisfaction of working for 'the case of love'.... I thought this kind of things happens only in my country :)


In this state of nervousness, petition - application or missing out a spelling 'F' is really the last of my concerns, but I am pretty sure people going through the process understand what was meant. Thank you for your correction though...
