My husband and I live in Haiti and have legal guardianship for 2 children (1 abandoned, 1 has biological family). Though we plan to adopt them, we have NOT yet started and won't for some time as we don't met the requirements. If we can prove that we have strong ties to Haiti (many vehicles in our name, bank account, permanent residency here (we are US citizens) contract with our organization,etc) will it be possible for us to obtain travelers visas for them? Our reason for wanting to go to the States would be to give birth to a biological baby. Thanks.

Your biggest issue is going to be able to prove that you have legal authority for your children by Haitian and US law. Assuming you have full parental rights over the children, the visas shouldn't be a serious issue.

Yes we are both US citizens. The government of Haiti recognizes us as their legal guardians, similar to their foster parents. But until the adoption is complete, we will not have full parental rights of them. The child with bio family can have a notarized letter signed saying they grant us permission to travel. But not sure if its even possible for our child who was abandoned. Even if it is possible, not sure that this will be granted. Just trying to figure out what the chances are.

It's not a question of getting their visas, but rather if Haitian authorities will let you leave the country with them. Whatever documentation is required for that will be required for both the visas and when you land.

It's not a question of getting their visas, but rather if Haitian authorities will let you leave the country with them. Whatever documentation is required for that will be required for both the visas and when you land.

Haiti was very concern with children leaving after the earthquake. There still may be very strict control about Haitian children leaving the island.

My aunt filed for a tourist visa for my cousin whom she is the legal guardian to and was approved--that was about a year ago. My aunt is not a US Citizen, but Haitian with a tourist visa. I asked her about it this morning and she said that she went through the same process as a B2 visa. In addition, she had to request a notarized letter from my cousin's parents stating that the child had been under my Aunt's care for many years and that they are ok with her traveling with her. Along with the official letter from the Haitian Government recognizing her as the legal guardian.
