i-864 but no W2's or 1099's

I've been searching for answers on the VJ forum but couldn't find exactly what I wanted to know, if anyone can direct me please help!

We are sending my wifes i-130 petition in this week, we are filing from France and I am here legally with a long-stay French visa, we are very excited to get this started and I am almost finished compiling everything for the entire visa process along with needed documents and translations.

I am assembling the i-864 packet with my sister who will be the co-sponsor

My question:

My income is very low, and I DO NOT have w2's or 1099's. Will this cause any problems?

I currently have:

2012 tax returns

2010/11/12 tax transcripts

employment letter

printout of bank deposits (showing personal checks as payments)

My deposit list matches with my income shown on tax return and 2012 tax transcript.

my sister who is my co-sponsor has the full i-864 nothing missing or incomplete

so again my question is: Will not including MY w2's or 1099 (because I have none) cause problems?

you use one or the other. You have tax transcripts. Which is preferred. you are fine. W2's, 1099 all that is in your tax transcripts.

you use one or the other. You have tax transcripts. Which is preferred. you are fine. W2's, 1099 all that is in your tax transcripts.

Oh ok, I understand thank you. I just thought taxes, pay stubs (my check deposit printout) AND w2/1099 were all needed. Which is why I was worried as I have everything I need exept I never recieved any 1099 or w2.

Also make sure you are NOT sending the I-864 information with the I-130. That comes much later in the process. :guides:

NLR,

I'm following the short cut guide for NVC so I am trying to have 99% of my paper work for the whole process finished and ready to go when the time comes. We are filing from abroad so we are in the possibility of USCIS progress going quicker than normal if they decide to do it that way. This way if it comes sooner or later either way I want to be as educated and prepared as possible.

i-130 packet is done, just waiting on the check from my friend from the states (in route via express mail)

Thanks for the warning though! It's easy to get so worried about everything that you start to send the wrong things or mess something up, so thanks!

Timeline

  • IRS Tax information (photocopy or IRS Tax Return Transcript) - 1 year is required, up to 3 years may help.
  • Tax Return Transcripts, optional but may help.
  • W-2s and/or 1099s
  • 1040 from most recent tax year
  • Pay stubs for current year (6 months should do)
  • Employment letter showing your income and position.

That is from one of the NVC shortcut guides, and note the point along with the 864 and packet it lists w2's and/or 1099's which was why I was asking about this process since I did NOT have any, every get any or see any this last year. My payments were personal checks from different clients (Residential window washing).

If anyone has any more info on this I would appretiate it, or even to tell me to calm down and shut up rolleyes.gif

We just used tax transcripts. They're from the IRS and contain all the information they need to know. :)

We also used pay stubs, but we didn't include an employment letter. His pay stubs show how much he makes in a year (states yearly salary.) Also since he's technically employed by the Department of Transportation, it's hard to get an employment letter but it's good to have if they're reasonably easy to obtain.

While your process will likely go faster, it will still take a few months, then about 2-4 weeks until the NVC... So don't delay in sending off the i-130 package, but keep collecting the rest in the meantime.

Ok thank you, that calmed me down a bit since I have all the other documents already. As soon as the check for the i-130 fee arrives (from my friend) our package will be on its way to the Chicago lockbox!

We aren't in an extreme time crunch or stuck with any problems, just would like to get to US before April since work there picks up a lot....we will see how fast the USCIS decides to handle our case.
