My Colombian fiancee (female) and I are in agreement that a prenuptial agreement will, actually, build confidence for us. So, we're going forward with it. She is still in Colombia and we are awaiting our K-1 visa. In preparation for the big day, I am going forward and preparing my documentation that an attorney will require prior to writing a prenuptial agreement (property, assets, stocks, etc.). I'm curious if there are any VisaJourney members with experiences to share regarding caveats to be aware of prior to an international marriage with regard to a prenuptial agreement. For example, I was advised to be sure that the agreement be written in both languages by an attorney who is clearly bilingual to guarantee that the non-English speaking spouse cannot claim that she did not understand all of the terms and conditions that she agreed to with her signature. Apparently, there is case-law that resulted in the overturning of a prenup on this basis.
