EAD and AP expiring before AOS processed

Hello everyone,

We filed for AOS from a K1 on August 21, 2012. A recent service request revealed that our case requires "additional review", and that we are to allow another 9-12 months processing. My EAD and AP will expire in less than three months from now (mid-October).

Do I need to fill out (and pay for) another I-765 and I-131? Or is there a way to request an extension since it is due to their slow processing?

There is no fee for renewing your EAD. Just be sure to include a copy of your I-485 receipt notice (NOA1).

The required documents are in the I-765 form instructions.

You need 2 passport photos and a front and back copy of your EAD.

You will file as category ©(9), "adjustment applicant"

Done with K1, AOS and ROC

Timeline

Yes, same thing and documents as when you initially filed for them, + the copy of your AOS NOA1. You still don't pay the fees. Your AOS may be approved by October, but you never know so best is to apply to renew your combo-card.

K-1 Visa Timeline AOS Timeline

- Aug 31st, 2011 - Mailed I-129F package - May 29th, 2012 - Mailed AOS/EAD/AP package

- Apr 13th, 2012 - Visa received - Aug 24th, 2012 - Green Card received

ROC Timeline

- May 19th, 2014 - Mailed ROC package to CSC

- Aug 8th, 2014 - Green Card received

N-400 Timeline

- Dec 29th, 2021 - Filed online. Got notice that biometrics will be reused.

- Now waiting...

Hello again everyone, I'm working on the re-applications for EAD and AP and have another quick question. I entered as a K1 and am awaiting AOS. What is my current immigration status?

The general consensus is to put down the status of last entry to US, which is K1 for your case.
