CSC transfers and FBI name checks

Are the FBI name checks for the cases that have been transferred by to the CSC being forgone? My husband is from a country that is infamously slow on the name checks, but we have a chance for a CSC transfer. I hope someone knows the answer to this.

K1 Journey:

2/07/06 I-129F sent

2/13/06 NOA1

2/28/06 NOA2

5/12/06 Boris's interview in Moscow

5/19/06 Visa in hand!

5/22/06 Boris arrives in Washington D.C.

8/06/06 MARRIED!!!

11/28/06 AOS, AP, and EAD mailed

12/04/06 NOA1 for all applications

12/07/06 All applications touched

12/09/06 Biometrics appointment letter received

12/11/06 All applications touched

12/13/06 EAD & AP touched

12/15/06 Biometrics in Norfolk, VA (very simple, took 30 min.)

2/01/07 FBI info line confirms biometrics were received and returned 12/15

2/07/07 EAD and AP touched, AP approved

2/12/07 EAD approved; card production ordered

2/13/07 EAD touched

I don't believe transfer to the CSC means that the name check has passed. IIRC there are several people who got transferred to CSC and have been waiting a long time since then, presumably because of the name check.

Really, rebeccajo? Because I had read elsewhere in the forums that namechecks were held up due to lack of cooperation of the beneficiary's country. But I guess you have experience with this topic, right?

I highly doubt they are foregoing namechecks for CSC transfers. That is the only reason I can think of why myself and other people have been waiting at CSC for awhile and other people are approved in a matter of days from their transfer.

Unfortunately I do.

I finally figured out the best way to explain this. As it's the FBI check (and not the IBIS one) that generally protracts the security clearance.....

The FBI's function is law enforcement within the US.

The CIA and other agencies handle international law enforcement.

As one of the people who've been waiting over 2 months for CSC to approve my spouse's petition after transfer, I'm going to say with relative certainty that they DO in fact do an FBI background check after processing your AOS application at CSC. (And no, my husband isn't the only one who's had a strangely long wait...CWR is at the head of the Longest CSC Wait Ever with something like 6 months, though that's of course nothing compared to Rebeccajo.)

As you can see from the timeline, his app was touched for a straight week, then nothing for more than two months. He has the problem of having a *very* common name.

Sort of, yes the FBI function is within the US, but if it is a domestic issue inclusive of Terrorism threat abroad the FBI still handles it. The CIA has no jurisdiction within the US. In other words the CIA are not sworn Law enforcement officers, but the FBI are.

I did get the low down on the FBI Name checks and yes they do contact nation of the intending immigrant. The person i was speaking to was telling me of a case that the guy was one of the students in Teiniman (sp?) Square, as a result China reported him to Interpol and now he can not get past the FBI Name check. China is still sees him as an enemy to the state.

Although, I still think that most of our problems are within the USCIS and the fact that there is no real motivation to get cases processed. While I realize that we have been waiting a short time, i truly believe that our case is on a shelf and nobody really has looked at it.

We need to reform the policy

Russia may be a slow at the name check, but there are probably at least 8 from the UK on the CSC Transfer list that may well be thinking the same about 'the old country'. Of course, I may be the only one that thinks this, but it does keep the mind occupied. Oh look its snowing....I think I'll just go watch the flakes fall for a while...

I think that's the IBIS check. One of the few things we know about IBIS is it checks records of other nations for persons who may be on lists that affect 'national security'.

Russia may be a slow at the name check, but there are probably at least 8 from the UK on the CSC Transfer list that may well be thinking the same about 'the old country'.

People from the UK end up in name check because their given names and surnames match USC names. We are, after all, the little country that broke off of Great Britain.

I only have to google my surname, and on the front page of Google, 7 hits are me and 3 are my cousin. Sometimes my brother and mother sneek on there as well.

Hell yes I googled him. I googled him when we first met on the web cause I was trying to make sure he didn't have some deep dark past........LOL

I get loads of hits. There is even a guy, some sort of successful computer genius, who uses the same name exactly as my husband does in his everyday life - ie same nickname!

What's more interesting is if you do zabasearch.com. If you don't 'regionalize' the search, (ie keep it nationwide, which is what the FBI is doing) zaba says something like 'too many hits to report'.......
