Processing times for i-130 and K-3 applications as National Benefits Center

Timeline

just found this on the internet....sounds like the application may be processed at MSC. Hoping that we will be able to spend my birthday in November together, or Christmas and as a last hope New Year's under the same roof!

Will definetly keep posting what we find out! :-)

There are two exceptions to the petitions sent to the field: those that are foreign filers, and expedite requests. Once NBC is staffed for this workload in 2013, we will assume jurisdiction of the stand-alone Immediate Relative I-130 petitions

who knows, if that info is still valid... Nothing is ever updated on the USCIS website. They change the date it was posted, but thats about it.

To add to that it also says"December, 2012 – NBC will expand to a second facility in Overland Park, KS. Forms I-90 and I-130 will be processed and adjudicated at this facility."

Does that mean all I-130 will be processed from NBC itself from Dec 2012?

That was the plan, but it hasn't really happened yet as people are still getting their petitions sent to local offices.

It goes to the NBC, who send it to the local offices. If both spouses are in the foreign country, there is no local office to send it to.

There is a chance it can be adjudicated anyhow at the NBC, but you will generally see an NOA2 within 3 months if that is the case.

How will we know if our petition is being transferred to a local office. I checked the San Francisco office, which would be our local office since my husband lives in SF and can see that there is only one i-129F waiting. Not sure if this is us or not....can i all somewhere and find out where the petition is or will my husband be informed by mail when it is sent somewhere other than where our receipt states, MSC?

the USC petitioner has to call the USCIS number, speak to a tier 2 rep (ISO) and then ask that person where the file is exactly right now, has it been transferred, if it has when was it done. To speak to a tier 2, you call and then wait until a person comes on the phone and babbles at you in spanish, then you say english please, and that transfers you to a CSR (tier 1 person). You have to ask that person to transfer you to a tier 2, generally "I need to know some items about my case that you can't find for me, could you please transfer me to an Immigration Services Officer (or tier 2)?" should work. You may have to ask more than once. They have to do it thought, and then you either get the call back or you have to wait.

Only the petitioner can do this. The process has really nothing to do with the beneficiary at this point.

Later at the National Visa Center stage is when the beneficiary can do most of the work!

To be honest, I don't know if our petition was sent to a local office or not. My husband decided he wasn't going to call for 6 months because that is the standard waiting time. He works for the government and says "Let them do their job first, and if they don't, then I'll raise a stink." So we did and it was approved in 4 months. Our local office would have been Denver.

Thank you for the information. My husband likes to leave the pot unstirred for fear that he will complicate and slow matters. Patience is something that is difficult for me. I am a doer. I will learn here to relax and hopefully be as fortunate as you and it only be 4 months! I would love to start the New Year together. Fingers crossed. I-129F and I-130 both filed. Receipt dates of May 31, but change in status from accepted to in process June 4, and May 13 with change in status on June 14. I don't care about the cost or hassle of where I may have to go for interview....we just want to be together. We have known each other since grade school and in a relationship for nearly 3 years. It is time to be together!!! Thanks again!

Did you file the K-3 as soon as you received the NOA1 for the I-130? The status changes could be them joining both files together. That is a good sign. At least you know they aren't lost...

Did you file the K-3 as soon as you received the NOA1 for the I-130? The status changes could be them joining both files together. That is a good sign. At least you know they aren't lost...

My husband filed the i-129F within a week of receiving the NOA1 from the I-130. The receipts show NBC KO for one petition and NBC MO for the other. The NOA1 for I-130 and I-129F are 16 days apart. The change of status on both files were June 4th for I-129F and June 14 for I-130. Fingers crossed that we are approved quickly.....as we all wish for our petitions!

Thank you for you replies. Having contact and hearing ANYTHING is comforting during this waiting game.

Just the stand-alone I-130. Meaning if you filed a I-130 with for a example the I-485 form it will not be processed at NBC.
