Hi everyone,

My husband (UKC) and I (USC) were married in December and want to live in the United States, not right away, but eventually.

He wants me to stay with him for about a year first to get everything sorted before moving permanently, we intend to file UK immigration for me in September.

Now since I won't be living in the United States when I file the petition, it appears that the DCF the only option we have for our situation, am I right?

It seems on first glance too to be a much easier or at least quicker process than filing in the States, or am I being hopefully naive here? lol

Hi, welcome to the forum.

There are actually 2 options, but if you both live in the UK right now then you should only really consider the DCF route. The other, filing via the USA, takes much longer (the guide for the longer option is here: http://www.visajourney.com/content/i130guide1 and it's usually for when the USC lives in the States and the spouse lives abroad).

So, if you're both in the UK you probably want to get and read London's own page on how to file direct. It's here: http://london.usembassy.gov/dhs/uscis/i130filing.html

DCF is considerably faster. I completed this week and it took us 64 days (as opposed to most of a year the regular route).

Yep, since you're not in the UK *yet*, then you'll have to wait for 6 months until you file DCF, as you say. But that's okay, since it sounds like you're intending to stay in the UK for a year anyway (so you'll probably file after 6 - 8 months after you get here).

Should be easy enough. smile.png I assume you're coming over to the UK on a spouse visa?

Oh, and just to be doubly clear - if you don't want to wait for the 6 months mark in the UK, you can file the regular I-130 for CR-1 visa via Chicago Lockbox at any time from now (following the guide I linked to above).
