Timeline

I have a friend(Nigerian) who came on a K-3 visa in March and has been married to his wife since 5/28/05.

He has been in the USA since March 2006. The problem is that he has left his wife because she was mentally abusive to him. She has made a false allegation of physical abuse to the police and had later went to the district attorney and told the DA it was all a lie. Also, she had allowed her children to call him racial names as well as made him sleep in the floor. She refuses to allow him to communicate with his family and friends.

His wife has refused to file for his permanent residency. What options does he have if he wants to remain in the US? Does he qualify under the abuse of a spouse by US citizen since he is a man? Is it possible he could get residency some other way than marriage?

Any suggestions would be helpful.

Have your friend consult an immigration attorney. He should keep all proofs of abuse, if he has any.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview
