k3 or ir-1/cr-1

This is my situation and I hate that it has come to this... My wife's mother is very sick and she needs to go home to be with her on Dec.5

I have filed for AOS and AP "advance parole" but we have not gotten the approval yet...

We have an infopass appointment on Dec.4 which we have a letter from her mom's doctor stating her condition, which we hope they will give her AP that day....

If they dont give her AP thay day she will leave anyway...

My question is if it comes to her leaving without AP, what would be the easiest way for her to re-enter the USA, K3 or ir-1/cr-1...??

I think that this the exact sort of situation they give emergency AP for - I hope your wife gets it!!

If she does have to abandon, there isn't an easy answer as to which is faster CR1 or K3, that's why the vast majority of people apply for both.

NOA1: 5-10-2006----updated w/ citizenship: 9-25-06----had to call back 10/25, touch 10/26

12/06/06 - Approved!- - - 12/08/06 - Touch---01/25/07 - Touch

12/14/06 - case number assigned

12/25/06 - DS3032 & AOS Fee Bill Mailed (phone system updated 12/27)

12/27/06 - emailed choice of agent; 12/29/06 - received email from NVC confirming choice of agent!

01/01/07 - NVC generated IV Fee Bill (postmarked 1/17 though!)

01/03/07 - returned AoS Fee Bill via Priority Mail (James' shortcut)

01/15/07 - NVC generated AOS package

01/22/07 - received IV Fee Bill - overnighted back to NVC same day

01/27/07 - recieved I864 package; 01/29/07 - overnighted I864 to NVC

01/29/07 - DS230 generated (phone system not updated, email response 2/5/07)

02/05/07 - mailed DS-230 to NVC via express mail

02/20/07 - CASE COMPLETE!!

04/18/07 - INTERVIEW!!!! - APPROVED!!!!

Michael's K-3:

09/28/06 - NOA1

1/25/07 - approved ...NOA2 via snail mail - 1/29/07

03/16/07 - chose not to return packet 3 to Montreal

ok.. i didnt know you could file 2 petitions... 2 applications = 2 fees, i cant wait :bonk:

I know it sucks, but the I130 is the only one that must be done. The I129F for the K3 is optional, and was designed to get couples together faster - it just isn't working out very well. Although apparently the I130 process used to take alot longer, so at least that's one positive thing :)

There may be a faster way to reunite, if it becomes necessary.

Read here at VJ about DCF/Direct Consular Filing. The Consulate may help you out here, and let you file the I-130 with them directly.

It's a very fast way to a CR/IR visa, when it's available.
