Why didn't you file joint taxes? Was it married filing separately or just single?

It was her idea, she thought she will get more money back if we filed separately, no it was married filing separately

Well, she was wrong about that, but at least it was ticked as married. You can use that.

You could consult with an immigration attorney for free if you like. We don't know your situation but I don't think a slap will work for VAWA, which is for systematic abuse. It sounds desperate and fake. Concentrate on your proof of entering the marriage in good faith.

My car and insurance are in my name only, it's her parents' house so basically there is no lease, i might be able to get affidavit from 3 people not sure though they might not agree because they are her friends, we had a joint bank account at first then she started using all the money my family had sent me so i stopped putting money in it and i think she closed it after that, we don't have health insurance nor memberships together.

I was thinking about the closet, that probably will generate a huge fight and eventually all what's in there that can help me are a few X-mas cards and also she will probably be vindictive and refuse to let me have them since her name is on there too.

I also understand that that evidence i had from before marriage won't be that helpful for ROC since i already submitted it when i applied for AOS.

Well the thing is, for ROC you're applying based on a bonafide marriage but a marriage that ended, so yes, some of the stuff you used for AOS could still be beneficial.

That old joint bank account for example, do you have any print-outs from it?

I would also include an affidavit/letter from yourself outlining the devolution of your marriage. DO NOT claim abuse. You will need to prove it and I'm sorry but you do not have enough proof for that.

You also don't need the actual cards, just copies of them.

Divorce and file for ROC based on divorce.

Thanks a lot everyone for the help, i will do that and hope for the best, do i have to file for ROC immediately once i'm divorced or can i wait a few months?

If you want to get technical, yes, because your current green card is conditional on being married. In practice, waiting a bit doesn't seem to be an issue.
