uncle as only sponsor

Hi everyone,

I have a question about that as well. My Uncle will be filling the affadivit as the only sponsor, but I just read on the London embassy FAQs that I am required by law to fill in the affidavit as well. I am a student and I have never filled taxes in the US, since I never worked (only internships). How does that work from here?

What is my Uncle supposed to fill in? What am I supposed to fill in?

Any help would be much appreciated because I just figured this out about 10 minutes ago...

Also, my Uncle lives in the US and I am in England so we are not part of the same household.

Do we have to fill in two different forms or is it the same one? How does it work? Any help would be great because I am a little worried about this.

More details that might be helpful:

I have never been a resident of the US, I was born a US citizen abroad and have lived in France and the UK since. My uncle on the other hand, has been living in the US all his life, and we will be moving to his house for a while until I can find a job, and we can get out own place.

You each fill out an affidavit of support. Each will give their own household size on their own form. As a USA citizen, you should have been filing tax returns, although you income is exempt for the first 95,000, and then any foreign tax paid is deductible from the countries you lived in. You could include a letter stating you didn't know you were supposed to file, given you've lived out of the country your entire life. But it might not hurt to file your back taxes for the past few years, even if you tax liability is zero.

But send a letter explaining you've been a student and had no income to file taxes on.

The point of the affidavit of support, is the filer of the petition is always the primary source of support for the immigrant (sponsor).

You each file I-864s.

He includes his proof of income, at least one tax return/W2 or a transcript, and proof of his citizenship or resident status in the US.

You attach a statement behind the I-864 that says. I have never been employed or earned an income because I was a student. I was not required to file US tax returns because my income has been $0.00.

Except that I can't be the primary source of support at the moment, because I was a student all my life and I am currently looking for work.

I can write a letter along with the affidavit of support and show school certificates, or grades or I don't know what to show that.

Your are required by immigration laws to fill out an I864 even with zero income. All you have to do is what I posted up a few posts.

Yep they'll understand that you'll have no income to start with, so your uncle is basically acting as the current support source, and the qualifying income.

No student records needed, just your signed and dated statement as Nick-Nick said.

The situation of no income in the USA for a returning citizen with spouse is pretty common, so don't get all worried about that. Good luck on starting a career here.
