I have one last question before I file concurrently. My husband is filing an I-864 along with our joint sponsor (his mother) who makes well over the guideline.
At the moment, my husband has filled out the form with his total income and attached 3 IRS transcripts for the last three years (even though his income won't be used).
He has some small assets, but we have decided not to include them because that part is optional and it wouldn't meet the poverty guidelines anyway.. is that OK to leave out the assets part? I have some income that I could potentially add to the household income but I do not have a letter from my employer saying the income would continue into the future so I was planning on not writing anything.

Basically my question is, is it OK to file his I-864 with his minimal income and list no assets and no other household income? I am guessing it will be OK since we have a joint sponsor who makes more than the poverty guideline? Should we send 3 years of his tax returns or is the most recent enough?

If the form and instructions clearly indicate that the Assets section is optional, and it wouldn't make any difference anyways, then leaving them out is fine.

Your situation (petitioner has no/insufficient income and includes an I-864 documenting this, joint sponsor has sufficient income)is basically identical to ours and everything went fine.

I would include 3 years of his tax returns if you have them.

8/07/2013 - Interview Notice Received.(online/text).

8/08/2013 - Interview Notice Received.(Mail).

8/09/2013 - EAD Approved.

8/17/2013 - EAD Received.

8/22/2013 - SSC Received.

9/12/2013 - AOS Interview - Further Review needed.

10/03/2013 - AOS APPROVED!!!
10/15/2013 - GC Received.

.....till 2015.

30/09/2015 - Mailed ROC Package to Vermont Lockbox

09/11/2015 - Biometrics Taken in Baltimore

19/08/2016 - RFE received

12/10/2016 - RFE response package sent.

04/11/2016 - ROC APPROVED!!!

25/11/2016 - GC Received.
