Hello again everyone,

Once again I appeal to the infinite wisdom of the board members.

As I stated in my post awhile back my children receive social security survivors benefits.

~The amount they receive is enough to meet the income guidelines for our household size.

~According to the instructions with the I-864, their income may not be included unless form I-864A is completed.

~Form I-864A can not be completed unless they are over 18.

~They are required to be counted in the household size.

~It is not necessary that their benefits be used to support my husband as he will have an ongoing source of income.

~His income will not be adequate to support a family of 5.

~ They each receive form SSA-1099 stating their name and their annual benefit amount. In the address box it lists my name; ex. Jane Doe for Junior Doe

My questions are:

-How can I show that the income they receive is for their support, thereby lessening the income burden of the household?

-Is this something I could accomplish by attaching an explanation or would I just go ahead and show all income on the I-864 individually and forgo the I-864A's?

-Is this income I would count as my own since it sent in my name for them and directly deposited into my bank account and if so how do I show it as mine without the supporting SSA-1099?

-Since I do not claim them as dependents on my income taxes ( I'm not required to file) is it mandatory that I count them in the household size?

"Your household size includes yourself and the following individuals, no matter where they live: any spouse, any dependent children under the age of 21, any other dependents listed on your most recent Federal income tax return, all persons being sponsored in this affidavit of support, and any immigrants previously sponsored with a Form I-864 or Form I-864 EZ affidavit of support whom you are still obligated to support."
