I agree with the above: In theory if you misrepresent your case you are commiting visa fraud.

But on a personal note: If you want to move to the US too, not only to be close to your child, but to make a life there, you and your wife should suck it up for a year and get the green card.

Reconcile with the wife. Get your green card. If you decide to break up later, then you still get to keep your green card.

You wouldn't need to remove consitions, if you and your wife have been married for over 2 years at the time of the interview. You'd get a permanent GC.

Personally, I agree with the people here who say get back with your wife (I understand you are on friendly terms with her) and shut up about separation for now. This is not fraud. Fraud would be to get married just to get a GC. You have been married for a while and have a child.

removal condition if you are married under 1 year.. but if you are married more than 2 years then u don't need too.. u will receive a 10 years GC and SSN so it means u can work here, when u stay here for 3 years then you can apply a US citizenship.. i have a friend same case for you..

If i were u, since your papers are already at NVC just continue the processing.. worried later when your the GC is in your hand. i don't think so there's a fraud with that one, as long the petitioner is aware..

fraud is when you just do it by yourself and the petitioner is not aware and you signs all the papers without her knowledge..

if your wife is willing to continue the visa processing that's fine.. you can still get divorce after you get the GC at least you can visit your child anytime.

who knows by time all of you are here in the USA we will change everything, you both get along together..

because if you cancel that visa processing, you need to wait your child to be the age of 21 before he/she can petition you.

the other way to enter here also is a tourist visa or working visa. but that is a 50 50 chance not guarantee , for tourist visA they need to look

all your financial document's . etc.

the question is.. is your wife is willing to continue the Visa processing? if not, then you need to cancel it.

Would someone be so willing to take a huge risk (financial obligation) to sign I-864 form for a soon to be ex-spouse?

I see "fraud" as obtaining family based green card with no bona fide marriage.

Try telling the Consulate officer during the interview that "I want to get the green card but my wife and I are divorcing soon."

He said it's already at the NVC the papers , so it means the wife is already sign it.

Fraud is more than what you described. Lying about the current state of the marriage would be fraud.

However, couples reconcile all the time. Once they reconcile, they are fine.

Who here has NEVER reconcile with a partner after you discussed parting ways? It happens all the time.
