Thanks, alos we are super confused about which form to use for i864.

Just a background information, my wife just graduated from medical school so she did not file taxes for the past 3-4 years. She just got an internship that will pay her for the next 3 years. Therefore, we asked her sister (my sister in law) to be an additional household sponsor. She provided us with tax papers and everything.

Now - (Correct me if I'm wrong) - My wife fills i864 (NOT EZ), and we are also getting i864A filled by her sister (who lives at the same address). along with her tax papers

the additional documents we are submitting are, a copy of publication from IRS (501) that states, since there was low income for my wife, and she was a student, she did not file taxes

is that correct. We are also super confused about 864, 864A or 864 EZ. Please advise

How much does your wife make per year? Is it over the poverty guidelines? Then don't worry about having a joint sponsor.

It doesn't matter if she was in school last year, it's CURRENT income. Last year my husband started his job, made 15k. But ya know what? He makes 60k a year, it's just that his 2012 taxes would say 15k from Sept - Dec.

BUT because she has not had this income reported in her taxes YET she should still sign a completed I-864 not the I-864ez.

The I-864a is to combine incomes in a household. The main joint sponsor should almost always sign a completed i-864 even if they live in the same house as the primary sponsor/petitioner.

If you choose to submit a joint sponsor, she needs to submit a photocopy of her birth certificate OR her entire passport OR her naturalization certificate to prove citizenship (unless she was an LPR in which she case she'd need to send a photocopy of her green card.) You don't need all 3, just one of them works.

My wife just started her job like 1 month back,and she has an offer of 51Ksomething (below 52 though). Also, since she was in school, she did not file taxes until 2012, therefore for which we have a letter stating that why she did not file taxes (reason being, her income was less than teh required amount to pay taxes and we are attaching an extract of the IRS Publication 501).

ALso, my sister in law lives in the same house as my wife, but what I'm getting is that we don't have to use a joint sponsor, because my wife's current income should be sufficient to support.

In other words, my wife has no savings, she just started working, so her total assests are literally worth 0. therefore we thought of adding a household member/joint sponsor.

My wife has already filled out the i864 (NOT EZ) and also, my sister in law has filled out the i864A

We are submitting a copy of the passport and naturalization certificate for my sister in law (she is a US Citizen).

Actually we did sent out the i864 on June 29, but what happened was that we sent out the OPTIN email request later,

So we called up NVC and asked them what to do, the Operator said, that they will only accept 1 way, either EMAIl or MAILS.

So we waited for the OPTIn email to be accepted and are planning to resend all the documents.

I will correct that on my timeline.

Household members who use the I-864a have to combine income. On your wife's I-864 she would have to note her sister as signing an I-864a and adding the income to hers. Also both would have to count each other on their household counts. Normally a household count for a petitioner without children, is 2. On your wife's it will be 3. If your SIL is not married, hers will also be 3. Their incomes will be added together at least on your wife's I-864. They also have to submit proof they are sisters and that they live in the same house. I'm not sure why you guys would do all the extra work. But to each their own. Just make sure all the forms are done correctly or they will be doing them again anyhow.

O ok perfect i get it now, I sent the optin the next day I got my case number the 4 of july and didnt get no answer if it was approved, then I got an email that the AOS was invoiced, i pay it, then when it appear as paid I sent out the supportive docs the 12 of july will that be a problem or am i ok?

I am waiting for my IV fees invoice.

Yes it was approved on the 18 and invoiced the 19 and I was not able to pay it into the 20... Im just waiting for it to show as paid to fill out the ds-260. Call NVC to check if the ds-261 has been reviewed.

Hi, So we submitted both the AOS Package with 2 i864s (using a joint sponsor) and my IV Package yesterday in two seperate emails.

Any idea how long does the NVC take to review it and provide an update? I'm checking other people's timeline and it says that people are getting Interview dates within 2 months of sending their packages.

If there are no checklists, should take them a couple of weeks (they would say 20 business days.) There were no Canada interviews for August on the forum, so your interview might take longer than what was happening earlier in the year.
