When to start preparing for ROC

Hey all!

Long time no see!
I've been in this strange bubble where thinking about immigration paperwork and filing were non existent.

Now back to real life...I feel a little outa the loop of things now.

My question is, when should I start getting my ROC ready? and how much in advance does it need to be posted.
I don't even know where to start right now!

Hoping someone can help me out, or redirect me to a instructional forum.

In reality you should have been preparing for ROC from the day of the marriage up to the day you submit the application. You have from 90 days before your 2 year anniversiary as a LPR up to the day your GC expires. You need to send in evidence that the marriage was entered into in good faith and not to aviod immigration laws of the US. This evidence includes joint fiancial statements covering the 2 years, joint taxes, joint liabilities, listed as beneficiary of each others employer's benefits, etc. There is a link here on VJ guides and ROC.

Thanks for the reply Dave, I probably should have been preparing sooner but an immigration free life is bliss.
This anniversary thing is getting me a little confused.
I file 3 months BEFORE my green card expires correct?

So, I'm confused on this sentence that was put in by another user. Isn't the day your GC expires is basically the second year anniversary as a LPR? Anyway, to reply to you OP, whenever you got approved at the interview, say October 30th 2011, your green card would expire (as it says on the card) October 30th 2013. So then you have to apply 90 days earlier, so July 30th, 2013. I hope this helps...and I hope I'm not giving you wrong info on this. Good luck!

You can file at any time within the 90 days before your green card expires, though you want to file early enough so that your case is received before your card expires. Ok, I'm relieved I did not give wrong info that is basically what I just said above. Phew! :)

We started ours from the day I arrived, putting paperwork to one side and ensuring accounts were in joint names as soon as we could and keeping records of dates and of course making sure our camera was charged when invited to family gatherings.

Mailing is not allowed outside of your 90 day window, they will only send you the packet back untouched! But you can mail it the moment your 90 day window opens prior to the 2nd anniversary of the GC expiry!

If you havent started yet and still have a while to go, I would start now doing a bit here and there, trust me it will save time and maybe RFEs later.

If you download the I-751 from the USCIS site with instructions, it gives the basics of what they want to see, you can then add onto that or expand on what they want.

Our packet weight a few pounds and was over an inch thick in evidence, but whatever you do, photocopy what you send and keep for your files, they told me that I had left page 2 out from the I-751 when I hadn't, but couldn't argue with them, would do no good!, but it was a quick fix in that I pulled page 2 out of our copy, copied it and returned same day! Cut down on time!

However, the generic evidence listed by others may be standard, your evidence is unique to you!

We put a cover letter with ours inviting them to visit at any time day or night!

What I suggest is that you put it all in a box with file folders following the check list and sort it out later for your filing. Sounds like you are playing catch up.
