Hello all,

My husband is of Lebanese origin and residing in Benin for about 13 years now. After his interview, he was placed in AP. That was 1 year and 5 months ago and we're still in AP with the Embassy here. A couple of months ago, I started to research what our legal options were. I have read that most US govt officials, more importantly, judges, consider anything over 15 months in AP "excessive". This enables petitioner/beneficiary to file a mandamus against the agencies involved in the immigrant's case. So basically it's a formal lawsuit against specific agencies such as USCIS or Dept of State, etc legally binding them to make a decision on the case within 30 days. It's an overwhelming step but can be taken when all other measures have been pursued with no success or decision on the case. This can be filed with or without a lawyer. It's a very involved process from what I've been informed, as beneficiary/ petitioner must present each specific agency with separate set of paperwork through mail, get case docket # assigned to the file, etc. So it's not for the faint of heart but is a possible solution to certain people's AP hell hole. Can you previous posters update as to where you stand now if possible? I would like to see if anyone has made any progress from initial AP? Thanks

I am U.S.A citizen and my my husband case going through AP for 27th month. I think because of his name they are taking forever. I just lost all hope.

I definately feel for you guys as my husbands application is not far behind yours. But why do you say i's been in AP for 27 months? If his interview day was in January 2012, like my hisband's interview, then that would put him in AP for 19 months so 1 year and 7 months as of now. Unless the Jan 2012 interview was his 2nd interview where he had already been placed in AP frominitial interview? In any case, his case falls into the same category as my husband's; their cases are considered in AP for an excessive amount of time defined by US government. Look up my previous posts about AP and details about what you might be able to do to help. At this point, it's very possible to get a lawyer involved and see if they can communicate with the legal dept of the embassy or State Dept so they can push things along on the basis of excessive AP. If that doesnt work then it's possible to take a more extreme measure; you or lawyer can sue the State Dept and/ or other agencies involved in the excessive delay, which is known as mandamus suit. I'm sure youre going through what weve been feeling for so long. Dont give up because your husband needs to know his wife is standing by him through these challenges and in the end it will hopefully be all over and you will be reunited rightfully. Stay strong for your own sake as well, dont give up hope. Keep us posted and let us know if anyone hears anything about their case.

I definately feel for you guys as my husbands application is not far behind yours. But why do you say i's been in AP for 27 months? If his interview day was in January 2012, like my hisband's interview, then that would put him in AP for 19 months so 1 year and 7 months as of now. Unless the Jan 2012 interview was his 2nd interview where he had already been placed in AP frominitial interview? In any case, his case falls into the same category as my husband's; their cases are considered in AP for an excessive amount of time defined by US government. Look up my previous posts about AP and details about what you might be able to do to help. At this point, it's very possible to get a lawyer involved and see if they can communicate with the legal dept of the embassy or State Dept so they can push things along on the basis of excessive AP. If that doesnt work then it's possible to take a more extreme measure; you or lawyer can sue the State Dept and/ or other agencies involved in the excessive delay, which is known as mandamus suit. My husband interview was in May 2011 since than his case is pending under adminstrative processing. They do not need any document from us. Back in Jan they asked for new medical and we send them. Since than his case is still going under adminstrative processing. All togather from applying and everything its been 3 years.

It's frustrating beyond words to go through this stage for so long when we don't know when the end will be. My husband's entire process has taken us just a bit over 3 years also from I130 and all. Just hang in there; there must be an end to it somewhere. Like I said in my earlier post, now that the case is past excessive processing times you might be able to see other options available to you. I have already begun doing the same for my hubby this week. We will see if any progress is made this week. Update us if anything comes through. Be strong and hang on a little more, this chapter will come to a close hopefully soon for us all.

As of now we have not filed. We tried pursuing the legal team of the Embassy here through a lawyer to call attention to the excessive timeline of the case. The case status has changed a handful of times throughout a 1 month period but its still under AP. We just might go ahead and file mandamus this month. How about you where do you stand?

Hello All,


My immigrant visa application is currently in administrative processing and it’s been
more than 11 months now. I am not a British national and am currently on a student visa in the UK. If I do not receive the US visa prior to my UK visa expiration, would it be possible to transfer my case to the US consulate in Dubai or my home country? I will greatly appreciate your advice Please !!!!
