I am a US citizen and my spouse is a Filipina. We married in the Philippines and had a daughter after our marriage. Do I need to submit things such as copies of emails, letters, Skype logs, etc., with the I-130 package? Our daughter will serve as proof of our bona fide marriage. Also, my wife will be bringing the following to interview: photo album showing pictures of us together during all of my trips to the Philippines; Western Union receipts showing that I have been supporting her; a few love letters, a few emails.

From what I read, it seems like the secondary proof of relationship is needed for the interview, but does not need to be submitted with the I-130.

Yes you still need to submit those things. A USC daughter simply shows you had sex, but does count towards bona fide marriage evidence to the USCIS. It should not be the only evidence you submit, however.

The reason you submit evidence before the interview is in hopes that the consular officer will see it before the interview. You can also send more with the immigrant visa package to the NVC after the USCIS stage. An officer doesn't not have to look at anything brought to the interview, they should have enough to make a decision after some basic questions before the interview begins. It makes it easiest on everyone, especially the immigrant! :)

Thanks to both of you.

My wife has a stack of those Western Untion receipts (about 150 of them). Should I submit copies of all of them with my I-130? With all the other papers and photographs, my package is going to be about a foot think!

Also with photos pick some random ones over time, some with family and some without, print 4-6 per a sheet of paper, then label them. This saves on space and weight.

PIck a few emails over the the course of the time, a few skype logs to show you talk daily/weekly/monthly, etc... No need to send all of them, just a selection of each showing a genuine relationship.

Send as much evidence as possible. An RFE can eat up a lot of time. The best evidence are pictures showing you together and with other family members at different times. The idea is to show you are in a healthy and loving relationship and not just married on paper.

  • Phone bills showing who called whom
  • Letters
  • Greeting cards
  • Chat logs
  • Emails / PM’s
  • Delivery receipts (of gifts you send each other)

2. Evidence of Visits / Vacations / Meeting in Person

  • Boarding passes
  • Passport stamps
  • Hotel receipts with both your names
  • Vacation / honeymoon photos
  • Receipts or bank statements showing remote ATM withdrawals (to show you were pulling money from that location at such time)

3. Evidence of Co-habitation During Marriage

  • Birth certificates of any children born to you together
  • Mortgage loan contract or lease contract with both partners’ names in it
  • Utility bills with both partners’ names
  • Receipts with both partners’ names in shipping/billing address
  • Pictures of you two living together

4. Evidence of Joint Ownership of Assets and Shared Financial Responsibility

  • Joint bank account statements
  • Proof of joint credit card use
  • Money transfer receipts
  • Power of Attorney
  • Wills (never used this)
  • Utility bills
  • Life insurance policy showing spouse as beneficiary
  • Health insurance
  • Car insurance

5. Photographic Evidence

  • Photos of you two together
  • Photos of you two with family (such as wedding, parties, kids’ graduation, etc.)
  • Photos of you two in various locations and times

6. Evidence from Others in Support of Bona Fide Marriage

  • Sworn affidavits of friends and/or family
  • Letters/cards from friends and/or family

Hi Bammo, We have the same situation as you, we have 1 y.o. daughter and she is living with me (im beneficiary), my husband (USC) didnt send any evidence with I-130, his lawyer only put our daughter's US birth certificate copy in i130 package.

Its gonna be 7 months soon we are still waiting approval and we have not any RFE yet but reading replies to your topic i guess he could send more evidence

I also prepared our photos together and money transfer receipts for 3 years

I hope the reason of delay is not because of he sent any evidence

Trim it down a bit... You don't need every email or every picture, take a selection and quality over quantity.
