Freaking out!!!

So I'm a VSC March Filer and just got moved over to Texas on the 12th. Now everything is moving along I took the time out to sit and think about the next steps. Everybody is saying about tax transcripts and stuff? I'm 18 on July 21st and my fiance is 20 and recently joined the U.S Military as an infantry soldier, he graduates in August... BUT he never worked before that. I'm so confused on what I gotta take to the interview in London, we have proof that he can support me, we have army documentation of his pay charts and we'll have bank statements from the last few months to show his pay each month which is $1,900. Once we get married his pay will rise as I will be living with him on base as a dependent. Is it possible we will be denied because we won't be able to show good tax transcripts from say the last 2 years? I don't think we'll need a co-sponsor because his income is good, but if we did because of the tax transcripts we wouldn't be able to get one anyway because his mother, him and his sister were made homeless 3-4 years ago and his mother is now on some kind of housing program in the U.S. My family are unable to do it as my father is ex military and bankrupt and my mum is a stay at home wife. I'm so so worried, please help in any way you can, maybe I have all this tax transcript stuff confused, my head is all over the place.

October 11th 2013: Received appointment letter
October 29th 2013: Interview (Approved) :DD
November 6th 2013: Visa in hand :DD ♥
November 19th 2013: POE, Newark International Airport
November 22nd 2013: Driving from NY to GA
November 25th 2013: Wedding♥

If he didn't work he wasn't required to file tax transcripts so he needs to write a letter stating that. If he recently joined the army he needs his pay statements or whatever other proof he can get (try posting or searching the military forum for how they proved US military employment) to show that's his job. Take a look at the I-864p and look at the requirements for 2 people based on active military. (100% vs 125%). As long as he makes over that, you shouldn't need a joint sponsor. http://www.uscis.gov/i-864p

London does not require tax transcripts, so no worries about that for the visa interview.Take proof of his military pay.

After marriage, there is another affidavit of support that does require the most recent tax return (or transcript) or a statement why he was not required to file. He writes a statement that he was unemployed in 2012, earned no income, and therefore was not required by the IRS to file a tax return. Attach that behind the form where a tax return/transcript would normally go. If 2014 rolls around before you get the visa, get married, and file for AOS, then he can do a 2013 tax year return because he is earning money now. That covers having the latest tax return. So there's two options for you, depending on when you file your AOS.

All good advice. I will add that I personally know of successful cases where income tax returns were not filed, because of the income level.

Other proof of income was accepted, such as social security income shown by SSA-1099 forms.

Use the proof of current miltary pay. If you submit a statement explaning the circumstances, make sure it is signed and dated by the petitioner. Take originals to the interview, to show if asked.

At the K-1 level, you must show income (or assets) above 100% of the poverty level; but when you're married, you must show above 125% of the poverty level, for adjustment of status. Consider showing 125%, even at this stage.

Having a co-sponsor would help. If your own income/asset profile doesnt meet 125%, ask friends and family about co-sponsoring. They dont need to be rich, they just show income/assets to boost yours.

Also search VJ for any possible miltary benefits/waivers regarding proof of support.

Actually if he is active military his threshold is always the 100% not 125%.


Also my statement above is for the i-864. I should read up more on the I-134 to give better advice! I apologize for any incorrect information. :( Just want to make sure you have the best chance possible!
