So if I couldn't get him for manslaughter without intent and there were no other charges that we could go for legally, I would have to say not guilty, because it isn't against the law to make stupid decisions.

True this - the verdict slip only had three options

1. Guilty of Murder in the second degree

2. Guilty of Manslaughter

3. Not Guilty

If they had found him guilty of either offense then they had to list other findings, but they were mainly for the use of a firearm additive sentencing.

Quite true. I personally don't know any gun owners who look for trouble. And I'd venture to guess that you'd never know a responsible gun owner was carrying 99% of the time. I don't know where some get the idea that people are walking around with a pair of six shooters strapped to their waist. Maybe they watched too many westerns?

But when someone is shot by someone who was following someone, yet can't fight I'd say that gun made them look for trouble. In this case the person carrying a gun DID look for trouble and when he found it he took the cowards way out.

Doing something stupid because it's technically "legally" doesn't make it intelligent.
