To be honest, with the charges they went after with, I think they overreached. The manslaughter without intent would be what I would have pushed for. If I couldn't convict within the parameters of the law, I would have to say not guilty.

No - the court determines what lesser charges are considered after argument from the prosecution and defense. The charges and lesser included charges allowed are part of the written instructions to the jury.

So if I couldn't get him for manslaughter without intent and there were no other charges that we could go for legally, I would have to say not guilty, because it isn't against the law to make stupid decisions.
