Hi guys,

I got married last May, and my husband is a green card holder, still 8 months to get his citizenship !!! as for me , next month I will be in an exchange visitor program ( J1 visa ) , and I will finish the program by the end of May 2014 ! my question is : what should I do to remain with my husband in the USA ? and what should i do if i come back to my country once i finish the program ?

My best,

Does your J1 visa come with the two year home residency requirement? If it is a government sponsored program then it does and you would need to apply for a waiver if you were to apply for AOS or to return home and apply for an IR1/CR1 visa. It is illegal to enter the country with intent to immigrate and join your husband there so you would be unable to apply for AOS. It would probably be best for you to apply for an IR1/CR1 visa whilst in the country, wait for your I130 petition to get approved, then return back to your home country to finish the process there.
