Question about I-864

Hi,

I have a few questions about how to fill form I-864.

I am currently in the US on a H1B with stable income since June 2011. I got married in January 2012. My wife (who is also my sponsor and the green card holder), has never had any income in the US and she is currently a graduate student in the US and she moved the the US in January 2012 after we got married. She got her green card in ~2004 but kept applying for a re-entry permit as she was finishing off her college in India.

I understand that I-864 has to be filled by my wife, On I-864, there is a question in Part 6 "My total income as reported on my Federal tax returns for the last 3 years". Should I be putting in my wife's income ($0) and mention that she has never filed taxes in the US (except joint taxes in 2012)? Or should this have my income here? Also, we filed joint taxes in 2012 so should the income for 2012 be our joint income (from Form 1040) and the rest be 0?

This is pretty confusing to me!

9/17/2013 - Got an email & Text at 4am Pacific for Interview date (October 21)

9/19/2013 - Got the interview letter in mail.

10/9/2013 - Got emails and texts about EAD and AP going into production.

10/15/2013 - Got another email and text about EAD in production.

10/18/2013 - EAD updated to "Card sent"

10/18/2013 - EAD updated with USPS tracking number (expected delivery on 10/21)

10/21/2013 - EAD/AP Combo card received.

10/21/2013 - Interview day (Los Angeles - review)

10/21/2013 - Another update to the I-485 (Decision - Registered as Permanent Resident)

10/23/2013 - Another text/email for card in production.

I-751 (Removal of Conditions)

7/22/15 - Documents sent
7/24/15 - NOA1 (Received in mail on 7/29)
8/19/15 - Biometrics done

I'd ask that question on avvo.com where you can get a free answer from lawyers. Many lawyers can respond, so you can compare the answers and as long as they don't contradict I think you can trust. Or, gather up all your questions, schedule an info pass on uscis website, and ask all the questions you have to the uscis officer. If you ask specific questions like this on the phone they don't give you an answer, but in infopass they will answer all your questions. At least it was the case with me.

I thought I-864 instructions said that if the immigrant that the sponsor is petitioning for is the sponsor's spouse, you can include the immigrant's income as long as you can prove that you will continue to get income from the same source after you immigrate. But there's a specific section for this. So I don't think you'd put your income in part 6, but you can include your income on I-864 anyway. For all the other questions, I don't know myself so like I said I recommend taking advantage of infopass.

@Coleman21, Thank you for your answer and for pointing me to avvo.com. I have asked my question there. Let's see what the response is. I have also taken an Infopass appointment (in case I need it. The appointment is in 2 weeks from now).

if the petitioner (your wife) is a USCitizen,

then she must file an I-864, even if 0 income.

If 0 income, then must secure a joint-sponser/co-sponser.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
