Hi all,

I have been reading these forums, but never posted before, because I thought this board was for K visa adjustees only (and I'm not one of them). But it seems like a nice forum, so I think I'll post here :)

Anyways, I have filed AOS in September, my notice date is Sept. 21, 2006. I already have an interview appointment for January 3, 2007. But...

I never got a bio appointment. It's been more than 2 months since my notice date, I called the 800 number, went for an Infopass, but they kept telling me a lot of bull - like, they never send bio notices less than 120 days after the notice date (how stupid is that?? Everybody knows it's not true!) or that I have to wait 60 days after my RFE received date (it'll be 5 days before my interview, makes a lot of sense!).

I see that everybody without any exceptions gets their bio appointments without any problems - people usually have problems with other stuff. I'm kinda pissed that it happened to me - I won't be getting an EAD and if my GC is approved, at the interview, they would still have to take stupid fingerprints before they can even issue me a card.

Has anyone ever been in a similar situation? Is it possible to just go to the ASC and ask them to take my biometrics without an appointment (I've already been told that it's not an option, but I still want to have hope...)?

I dont think that you can get a bio appointment without your letter due to the details that they need of your case.

However, they will probably do your biometrics at your interview which isnt that far away so I really wouldnt worry yourself about it. The only hold up might be name check if you dont receive your bio appointment before your interview, but with the way things are going weirdly at "USCIS atm who knows...

Name check? I thought fingerprints were for my criminal background check, not for the name check. Because if they need my fingerprints for my NAME check, then I'm in quite a situation here, cause I've had 3 last names in my life, and at least one of them is pretty common. I'll be stuck, and so will be my work authorization :( :( :(

I read on USCIS web site (the old one, I can't find this info on their new site), that criminal background check and name check are not related, and I thought they might have started my name check already (they know my name after all!). BUT if its true that name check begins only after biometrics are taken, then I'm totally screwed!

And I could care less about the green card, but I sure could use a work authorization, cause our combined after-tax income is currently about $300 a week, which sucks more than you can imagine.

I guess, I just have to wait...

Regarding the namecheck, that is why they want all names used on your paperwork but this following link might help a little with what happens during this process....

Honestly, dont get to concerned at this stage about checks they are done for everyone at some stage of the process.... I dont know whether or not they start the name check before the fingerprint check or do both together... All I can say is that it isnt long for your interview so wishing you well and hope that all is good for you for your situation. If all goes well you shouldnt have too long a wait for your greencard and will be able to help with income. Just in case, did you apply for work authorisation?

Yes, I applied for EAD, but I think I may not even get it since my interview is so soon.

05/12/2009 -- Overnighted application by USPS express mail (VSC).

05/14/2009 -- Green Card expired.

05/23/2009 --- Check cleared bank.

05/26/2009 -- Received NOA (NOA date May 15, 2009, guess they aren't deporting me).

05/29/2009- Biometrics Notice date

06/01/2009- Received Biometrics Letter

06/18/2009 - Biometrics

09/23/2009 - date of decision to approve (letter received), just waiting for card. No online updates whatsoever.

My wife received a biometrics appointment for a month after her AOS interview (she received the letter 2 weeks before the interview) - at the interview the interviewer issued an order for biometrics for the same day - it delays your green card a little but its not so bad - she got her green card about 8 weeks after the interview/biometrics - both were done the same day. Good Luck

Nah, not true. I never received a Bio appointment letter either. I went to have my bios taken after the interview and still received my card only about two weeks after the interview. I never got my ead either, I guess, because there was never any bios taken and calling them is a waste of time and nerves anyway.
