It is not screwed up at all. She used deadly force without justification. She endured the same type of trial GZ did. She was found NOT to have justification for deadly force, GZ was found TO have justification.

The rulings are exactly consistent with the law. The use of deadly force does not always entail death. Even pointing a gun at someone in self defense is a use of deadly force, firing a shot is aggravated assault unless you can claim self defense. She had the same burden of proof GZ had and failed to meet it. Mostly because her assailant was in the courtroom.

NEVER fire warning shots

I believe here in MA brandishing a firearm can be an offense, I think you can be charged with assault.

On the other hand it makes perfect sense. She was warning off her her abusive husband. That restraining order she had on him doesn't mean anything beside his basic civil right as a minority to batter and beat her up.

She is lucky she isn't facing federal charges.

On the subject of the other lady and warning shots, it has been argued successfully in court that warning shots actually invalidate a self defense claim (even if you have one to begin with, which it seems she didn't). The argument goes that if you are really in fear of great bodily harm, you wouldn't fire warning shots. You'd shoot to kill.

I think this is a ridiculous argument. Firing warning shots makes total sense to me.
