My fiance and I have NOA 2 and are waiting for him to receive packet 3. We both want to move from my current state to another we had in mind. I heard it's best not to move until after our wedding, which I am perfectly okay with. My question though is after our wedding if we move to the chosen state, how long do we get to live there before our deadline for filing AOS is up? The reason I am asking is that once we move I will need to find a job, and we'll need to pick out a place and other things that will take at least 3-6 months. When is the best time for a K-1 applicant to move? do we have to wait until AOS is even over?

There is no requirement where you marry or live when your K1 arrives or if you move before he arrives. You can wait as long as you want to file AOS, but the beneficiary will not work or get a driver license until you get on with the road toward permanent residency. The thing you do need to consider is the affidavit of support. If you move without a job established in the new state, you will not be able to show you can support the beneficiary on your own for the AOS application or interview.

The only requirement is that the two of you get married within 90 days of the beneficiary's arrival. IMHO, I would either get married and move or move and get married and then file for AOS as soon as the petitioner can prove support above the 125% of the poverty guidelines and you can afford the $1070 filing fee. The sooner you file for AOS the sooner you get the USCIS out of your lives and the beneficiary can work, travel internationally, and get a DL. If you wait too long to file for AOS, there are other costs that will come into play like a new medical exam. Given that the USCIS has a bit of a problem with updating addresses, I would get settled and then file for AOS so your address is correct on the application and you do not have to go chasing down approval notices and BIO appointment letters, etc.

Good luck,

Dave
