Is it okay to apply for AOS if I move?

We have our NOA 2, and my fiance is awaiting his medical and interview. However, I was wonder if after we get married I decide to move to another state is he allowed to come if I update my address and he comes with me? or...do we have to apply for AOS in my current state and stay here until it finishs before we can move?

USCIS is a federal entity, and therefore not bound by state boundaries. Be sure to inform USCIS, as required, of any and all moves….the sooner the better.

You probably would not like USCIS to send important information and notices to an incorrect address, likely resulting in unnecessary delays.

As A&B said, it does not matter where you live in the US. You are free to move at anytime. However, it could save you any hassles with mail going to the old address instead of your new one if you file for AOS after you move. If you do move after you filed, just be sure to let the USCIS know of your address change and make sure they have it updated in their system.

You just need to marry within the 90 days after he enters the country. You should try to file for AOS before his i94 expires - Once his i94 expires he is technically out of status until you file the AOS. We moved after filing for AOS and it was no problem. WE got text and email confirmation from USCIS that our address had been updated in their system. It was no problem
