I know, trying not to judge the TSC, but I would have felt more comfortable with my petition in VSC rather TSC. Texas isn't exactly the best sponsor for LGBT. Enjoy your visit!

so i dont think and i am sure TSC is going to process same sex cases the same way as the rest of the centers

so i dont think and i am sure TSC is going to process same sex cases the same way as the rest of the centers

Oh I know, and I can't wait to see the first approved LGBT from TSC because so far it's been approvals only from straight couples.

I would have felt ten times more comfortable if VSC had still my petition.

My fiancee and I have our NOA1 and intend to marry next year as soon as she gets to the US. Once we marry, she intends to take my last name. However, we also plan on returning to Peru approximately six months after our marriage to visit her family. Once her last name is legally changed to mine, her Peruvian passport will still have her maiden name. Peru doesn't recognize gay marriage...so all her US identification will have a different last name than her Peruvian identification. How do we get into Peru and back to the US with two different sets of identification/last names? Does anyone have experience with this and/or recommendations?

i dont know if that helps you, but thats what i know so far.. in Paraguay gay marriage is now legal YET.. i just wish it was legal all over the globe already.. is just non-sense..

It has been 2 weeks and 2 days (yes i'm counting) since we received our NAO2. This is driving me crazy checking emails and regular mail every day. I have never checked my mail this much in my life lol. We are raring to go NVC lets get a move on. We have already compiled everything we need for "packet 3" so the waiting game is awful ughhhhh

Thank you for the information. We're looking into options in Peru after the wedding....but it may not be feasible. Someone mentioned that we can buy plane tickets in her maiden name and use her Peruvian passport to get back to Peru, then when we return to the US show our marriage certificate....that might be the easiest solution. Well, it didn't go so well with our attorney and we finally decided to file it ourselves (which is what we had planned all along). However my F-1 status will be canceled soon if I don't register for school as a full time student by the end of September. However, while I do wish to finish my studies, I really can't afford to still go to school full time, especially since my wife is disabled... any advices? We want to send the application in two weeks once our joint sponsor has gathered everything (we had trouble finding a joint sponsor since neither my wife nor her parents qualify).

We had a similar challenge. My partner is Australian, and while we can register our relationship in Australia, our US marriage (and, therefore, our marriage certificate) is not recognized. Here's what we did...

She traveled to the US under her Cxxxxx name with her Cxxxxx passport name. When we married in New York, she ticked the box to indicate that she was taking my Bxxxxx surname.

One month later she travelled home to Australia with her Cxxxxx name and Cxxxxx passport. She then went to the Department of Births, Deaths and Marriages in Queensland and petitioned to change her surname to my Bxxxxx surname. It's pretty easy to petition to change your name in Australia as long as you are not doing anything illegal.

She then changed her driver's license and passport to her new Bxxxxx surname.

Before we left the US, we changed her name to Bxxxxx at our bank and on our joint credit card. Other than those two things, she had no other "connections" to the US with her Cxxxxx name.

The hardest thing we had to do was to change an outstanding airline ticket. My partner had an outstanding leg of a "round-the-world" ticket in her Cxxxxx name. The airline was more than happy to change the name on the reservation with a copy of the Legal Name Change and her new passport.

The next time she enters the US - her ticket and her passport will show her Bxxxxx name - so everything matches!

Unfortunately a name change in Peru is not as easy to accomplish. From our research, you have to go before a judge with an extreme hardship in order to be granted the change. The other option is for a woman to change her name to her husband's. We didn't see any other options available. Maybe we're not seeing all the information, but that's what we dug up so far....so a Peruvian passport with the maiden name, a marriage license, and a GC with the married name might be our only hope. Thank you for your input though...we're happy you and your wife had an easier time with it. Maybe someday we will too. :)

And, just as unfortunately, I think the green card and the passport have to match. Your only option at this point may be for your partner to keep her family name. I'm sorry Peru makes it so hard.

Hi ivanalex,

The reassignment of many same-sex fiancé petitions to TSC in August was done as an effort to take some of the burden off of the VSC, which apparently had an excessive workload that was affecting processing times. Many opposite-sex petitions were transferred as well. Because almost all same-sex fiancé petitions would have been filed following the Windsor decision in late June, most if not all same-sex petitions would have been transferred to TSC as part of the general transfer of recent petitions. So to answer your question, this was an administrative move and same-sex petitions were not being singled out. I think the concern that some of us have is that because Texas is generally not viewed as a "gay friendly" place, there may be a tendancy among personnel in the TSC to view same-sex petitions somewhat differently than opposite-sex petitions, and I don't mean that in a good way. That is clearly not official policy, and I sincerely hope that it is not the case, but I will feel more comfortable when I see some same-sex couples receiving approvals from TSC along with the numerous opposite-sex couples whose recent petitions have been processed by TSC quite promptly.
