Finally got a schedule for GC interview in September! Still not a peep regarding EAD and AP.

Excellent news. It's strange how cases are on such different timelines. We have the EAD/AP but no hint of interview or not and status still stuck on Acceptance...

I don't know what else to say! There is no systematic processing schedule, apparently. I would rather have the EAD early so I can get a new state or drivers license but I'm not complaining regarding the relatively fast GC interview date.

Hi Davesings, yeah you are about 1 - 2 weeks behind... interestingly from I-129F, to the consulate interview, wedding and AoS... which is pretty cool. Good luck. If my timeline serves as a reference, you should be getting your EAD/AP next week of the week after next. Don't forget to apply for SS# too.

Mine is stuck on RFE Evidence Review since late May. I received the EAD card and at least work is keeping me sane (or insane, but at least work is not personal, unlike AoS). I see you just finished Biometrics so you'd likely have a month's wait on your EAD. Good luck to you and I'll update as soon as I hear something.

Just checking in! Same-sex couple filing from Finland. Been in a registered partnership since 2006, but of course that wasn't good enough so got married in Canada in 2013. It's crazy it was not legally possible for us to get "married" anywhere in Europe because they considered us to be married already, despite not having the right word in our union. Probably should have filed for a K-1 instead, but it just seemed ludicrous to do that since we felt we had already been married for over half a decade! Hoping to be reunited soon. I'm one of the first 5 same-sex couples in the country to receive a K1 visa, it's incredible to be part of this 'history', if you can call it that.

I've recently just submitted my EAD and GC application, and will continue to be in a weird legal limbo for now I guess.

Well today we received the Notice of Potential Interview Waiver, which said the case will be delayed by about 6 months...We are not too annoyed since at least we have the EAD/AP.

Well today we get this email from USCIS.

The interesting thing is, we never received the RFE. It was handled by our attorney who did not even mention that they had received it. After talking to the attorney's office, they said the RFE was for an improper signature, but it was really an error on USCIS for not reading correctly. So let's see what happens.

It looks like you've caught up to my application now. I just received the Interview Waiver notice, dated August 13, 2014. I agree, having the EAD helps as I am back to being gainfully employed and feeling much better about life.

I was just wondering if any same-sex couples had filed for their AOS in Texas? We're currently in the Bay Area but pondering a move to Austin. Wondering how that'll play out with the USCIS. I'd expect to be treated fairly anywhere, but any data on this would be nice

Just as background: My husband came from Italy; we did a K1 last year (getting the first same-sex one out of Naples) and got married in December. AOS was in San Francisco in March and Green Card was granted. But if we move before 2016 we'll have to file the I-751 (removal of conditions) in Texas.

BTW, if anybody out there who's earlier in the process has any questions, just reply to this post. Happy to share info.

We filed at the Chicago Lockbox and used the Fort Smith, Arkansas Office for our biometrics.. We live in redneck, homophobic Arkansas. When we went for the Biometrics, we were treated very nice. No problems whatsoever.

I haven't gone through any family-based immigration processes, but I believe that as long as you were married in CA where your marriage is legally recognized, you should be fine. You'll be held to the same standards as a straight couple. I believe your case will go through the San Antonio field office, but apart from some extra driving, there shouldn't be any difference between removing conditions in Austin or San Francisco. You won't be the first same sex couple to adjust status through San Antonio.
