I'm putting together the requisite docs for AOS from F1 status and I've a question regarding I-864.


My spouse and I have worked for just one year (which means we have both each filed only once for tax return).


Her earnings does not meet the poverty limit. However, our combined income is above that.


I understand we need tax returns for past three years. Kindly advise on how we can handle this. Thank you

You will need a joint sponsor. Are you a USC or LPR

That is incorrect.

OP: one year's solid employment history is plenty. File with the joint income, assuming it will remain after AOS- ie the employer will keep the foreign beneficiary on after AOS. Include a short explanation/ cover letter with your AOS that explains why you only have one year's tax return, ie you did not work as a student.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I am still a student, but work for my school. Like I said, our individual is below the poverty line, but the combined income is above it.

And we'd would still have our jobs till the end of the AOS process. Does this imply I wouldn't need a joint sponsor?

Yes, you won;t need a joint sponsor as you can combine income wiht your spouse, and you have current and ongoing income that is enough.
