Guys! pls give your feedback, share your experiences w me if anything similar happened to you, I am little scared..

Here is my story - I got my Conditional GC in Feb of 2012, and due to apply for a permanent GC in November of this year. Still married to my husband, everything is good on this front!:)

I was looking over the application for removing conditions and came across this question:

Have you ever been arrested, detained, charged, indicted,
fined, or imprisoned for breaking or violating any law or
ordinance (excluding traffic regulations), or committed
any crime which you were not arrested in the United
States or abroad?
2 month ago I was at friends bday and we were smoking outside a restaurant, threw cigarettes on the ground and policeman saw us, gave a ticket for it. I went to traffic court, paid $400 fine and completed 8 hours of community park cleaning....
First of all - will I have to answer "yes" to question above?
Secondly, is this a serious violation and can negatively impact my case? Please help!

What were U smoking? cigarettes...that's littering....weed even if under 30 grams

you should consult with an atty, there are attys that give free consultations...get

the record of arrest and community service in your possession just in case U need it

Don't sound like a major deal but the best thing would be to get professional advise it

it was marijuana

Of course you would answer yes, it says "have you ever been... fined" and you have.

Second no. I don't believe a single count of littering is a serious offense. It should have no bearing on your filing. Same with speeding tickets etc. You will of course need to mention it and you should take the ticket, and court disposition with you. I would also take proof you have finished your community service.

thx for your feedback, guys! it was just a regular cigarette. the reason I had doubts on what to answer is because the question on the immigratioton form states "excluding traffic regulations", and cigarette littering (even if not conducted from a moving vehicle like in my case), is supervised under traffic regulations, and is handled by traffic courts. Also the fine was under $500.. just a bit confused with this but guess to be safe to answer "yes"..

I understand your confusion in that regard but it's always better to be safe than sorry. Most likely they will completely ignore it.

Be aware though, come N-400 time (citizenship) you will also have to tick yes. In my case I have a traffic citation, i listed it but I still received notification that I need to take "evidence of my arrest" to the interview. The traffic citation/fine section also includes the words "if you've been arrested" so you WILL most likely get a notification like I did. Don't freak out (unlike myself) and just take it to your interview. Shouldn't be a big ordeal at all.

What happens if you get a ticket but no evidence of arrest. For example, I was giving a ticket for driving with only my parking lights on. Do you have to say YES, since exemption of was given for driving tickets, even though mine was not a moving violation?

You are not the OP. So which form are you talking about? I-751 or N-400?
