Past Suggested Processing Time on K-1 - What do to?

Hi all,

I received my NOA1 on Feb. 12, 2013 for my fiance. It was 5 months this past Friday waiting on the NOA2, which means on Monday my case is outside of normal processing times for Vermont.

What should I do?

I've followed this forum for awhile, so I know I can call USCIS, but how do I actually get someone on the line there? I think I can write to my congressman to look into the petition as well?

Hi Shahara. My NOA1 came in November 2012. I am still waiting. Your petition is not out of normal processing time so you may get it in a few more months. If you file a service request you will likely get a form letter back stating Yemen petitions are on hold. I don't think this is necessarily true but it's what USCIS is claiming. No one can tell you how long we'll all have to wait. You may have to wait less if your beneficiary is a woman. I recommend harassing them as much as possible via inquiries, info pass appointments, and congressional or senatorial inquiries. Good luck to you.

Thanks for the reply.

My fiance is a male, Yemeni. We met when I was a student in the country in 2009.

Can you help me make some sense to the outside the normal processing time thing. I know processing times change, but the USCIS website now states Vermont is processing at an 'average' time of 5 months. What am I missing? I know that 5 months seems quick from what I've researched here for the NOA2 (with many people this past year waiting 7,8,9 months for approval)- but it looks like that is what it now states when I check the case status website as the average time. Does that not make the case outside normal processing times?

and, WOW, you got a reply that all Yemen petitions are on hold before even making it to the embassy stage?!

I just want to start being active as seeing is as reasonably possible, and I have a right to do so, if I haven't heard.

Wishing you luck on your petition, and that you get word very soon. I could imagine with 8 months creeping up on not hearing can be a tiny bit frustrating when others have been through and have their fiance's by there side.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I sent my first e-service request when the petition became 6 1/2 months old. That's when I got the notice about petitions on hold. Is it true or not? No way to say. There are petitions being approved they just take a lot longer than other beneficiary countries. My plan is just to harass as much as possible (maybe once a month) either on my own or through congressmen or senators. You can also request an infopass appointment with your local office. Again they won't be able to comment on your case or give you a timeframe but every request you make is noted in your file. Even if it doesn't help that much, it will make you feel like you are doing something.

Glad to see another Yemen K1 person biggrin.png we are few and far between.

By the way 5 months is the USCIS goal. Their average, particularly the Vermont Service center can be 6-7. They have even moved some case files around to lessen the backlog. Please keep me posted though.

You need to contact a Tier 2 immigration officer.

The people you initially speak with are Tier 1. Once you reach one and you provide them with your information ask to be transferred to a "Tier 2 Immigration Officer" from there, you'll be transferred and there's typically about a 2 hour wait. If you have a US number, you can opt into the "call back service" They will call you back and you won't lose your place in line. It helps so you don't waste cell phone minutes and can go about your day.

On a side note many people complain that the T2 IOs are rather rude, so always remember to be polite. The one I spoke with was a bit curt at first, but once he realized I wasn't going to chew him out, he was very polite and helpful. :)

Hello everyone! Sorry I'm in the wrong topic I really need help. Me and my sister entered the U.S last June 26, 2013 via K2 visa and our POE was Detroit. We weren't issued i94 because they are automated now. It's been 3 weeks since we got here and I still can't access or print it out from the website. It still says "Not Found". I tried putting my 2 last names already (as the lady says), and switching my names but it still won't show up :(((((( PLS HELP. We need it for our SSN. Please message me
