Self-sponsoring for AOS

Hi there

I need a bit of advice on the above. I have a written job offer in the US and can start work once I receive my employment authorisation. However the job requires that we move to a different part of the country, which in turn means my fiancée will have to give up her job where we currently live.

My question therefore is: am I able to use the job offer to self-sponsor as I will be making more than enough money to support both of us, and my fiancée (the USC) won't have a job when we move.

Can I submit the job offer in place of the affidavit of support?

Any advice would be appreciated here.

If your employment is legal (i.e. you have work authorisation) and it will continue from the same source after your green card is approved, then you can include your income on your wife's I-864 when you file for AoS.

But what would be the point of my wife filing an I-864 when she wouldn't have a job?

As stated above my employment would commence as and when my work authorisation is granted, and yes the job would be permanent and long-term.

Still not clear on this....

The US citizen spouse is always the primary sponsor, even if their income is $0.

The US citizen spouse is always the primary sponsor, even if their income is $0. You cannot successfully AoS without the spouse filing an I-864.

OK thanks - I see now there is an area of the form which asks whether the immigrant's income may help boost the total...

Aren't you going to have cash from a house sale? Read page 7 of the instructions about assets of the intending immigrant.
