The way the brother comes into play is he is the one that introduced us and I wrote that in my how did we meet letter. (I was visiting him one day he forgot to log out of skype and his brother and mother called him, I thought his brother was cute he thought I was cute we started emailing etc.). I was expecting AP, the thing that has me worried is the CO telling him is file is being sent to the US, as she throws his passport at him. I have looked all over this site and I can't find anything on AP in the US. I am happy to wait out the AP if there is a good chance of approval after.

Wow, throws the passport? Incredible how some people treat others in these situations.

The fact that the file is sent back to the USA means it probably be a long time until anything is known. The cases I have seem here on V J where that happened didn't turn out well. Darnell may be able to comment with more experience than I have on this.

To me this is all about the power of love and timing. You will have to wait a long time in total agony and then find out it was all for nothing. During that time you could have made some progress towards what this is really all about which is being together in a relationship. I wouldn't wait for some government agency to tell me what my fate would be while I waited in limbo. The real difference is the timing of the marriage if that's what you intend to do anyway. Again the K 1 just means its 90 days away unless you aren't sure of what you want.

Also the CR 1 type is a better visa because it gives him a green card much sooner so he can go to work. This may be important to both of you in the end so he can feel he is productive sooner ect.

If they returned his passport and said it is being returned it is not AP as others have said. It will be interesting to see what the paper says. Did you call the State Department to see what status the embassy gave them?

If it is a denial you need to see if you can keep it at the embassy and get it overturned. Anything is possible, we did it.

Hang in there, I know it is hard but it is all worth it once it is all said and done.

Also... marriage in Algeria will take months due to paperwork, so make sure to understand what is all involved before going that option. We opted for msrriage in Tunisia.

The bottom line though is if he is denied now you will still have the same issue to address. You might just want to wait it out and see the actual result before choosing an option.

Thanks for your advise, I just called the department of state and was told it is AP at the embassy. I feel better now.
