Hi all,

Yesterday my fiance had his interview at the embassy in Algiers. It didn't go very well, the CO was not nice and at the end he was put on AP, but he thinks the visa will ultimately be denied. They think he is being dishonest because his brother came here on a k1 and his marriage didn't work out, what one has to do with the other I don't know. It is crazy to me. The way I see it we have 3 options, wait out the AP and hope for the best, I go to Algeria and ask to be interviewed to see if that helps, or I go to Algeria we get married and start the process over. I honestly don't know what to do, we don't want to make any mistakes, but like all of you we are tried of being apart and want to choose whatever path will get us together the quickest. Please, give me your thoughts good and bad. Thank you

You are dealing with one of the most difficult areas in the world in my opinion. What has happened is nothing new. They are very careful it seems probably due to the past events that must have occurred.

AP is very difficult to endure because you cant get info nor affect the process. By the time you find out what they decided its too late to do anything but you really cant do any more anyway. They will not interview you.

My suggestion would be to marry and file for the CR1 type visa. Even when doing that you must be careful to make every effort to be able to prove the relationship when the time comes.

The embassy will not interview you at your request. They handle that in a couple of different ways if they want to talk to you they will call or email him to come in for a second interview or the embassy will telephone you at the number you put on the forms.

I would not rush out and get married. Try to wait the AP out and see what their decision is. You could very well get the visa. In the mean time continue to produce proof of relationship. Phone records, emails, etc.

I know how hard the waiting can be my husband has been in AP for a long time but I think the biggest mistake you could make is to not give the embassy some time to make a decision about your case. They did not deny him on the spot. Most Muslim males and males from that part of the world go through AP these days so it's not unusual that he is in AP.

The embassy is really trying to look out for your best interest. His brother got over here by using the K-1 then later ended up divorced but most likely still living in this country. They just want to make sure the other brother, your fiance, is not using you to do the same thing. It looks like the family wants to marry American women just to get over here and then divorce them. That's the way it looks to the CO. Just give the embassy some time. That's my 2 cents worth.

Did he get a paper at the interview? Did it say AP? If he were denied they would've told him and given him a paper telling him he was denied. AP is normal for MENA. Even if it's a longer AP, it's much better than a denial. I agree with what carolynhotstuff said.

Where did you or they get the idea that the brother was somehow involved in your his K 1 application?

As far as timing of you getting married I am sure you know you have 90 days to marry once he is in the USA so going there to marry isn't exactly rushing the idea by much anyway.

One member advises that you should wait for AP. If the brothers actions some how affect this procedure then we know the outcome of that AP. The only way around that decision would be marriage.

No one knows what the outcome will be at this point but most cases like this are sent back to the USA where people are advised to file appeals ect which never works and takes months to years.

Waiting for the AP process to occur can take many months during which you will not have any idea of what is going on nor a clue as to the outcome. Your fate lies totally in the hands of the unknown person.

I don't agree that the embassy is looking out for your interests. They are looking out for the USA. They have no way of seeing into the lives of all the people that attempt a relationship other than to ask for the info they do. If that meets the criteria they approve the case. Right after its gone thru A P. The question really is what is involved in A P in these cases.

You will have to determine what path is acceptable and how long you are willing to wait for such efforts to get what you want. Going there to marry takes time and effort. The day after you marry you could send in the forms you would have prepared in advance. Doing this is the only way to have any real control of your own future.

The way the brother comes into play is he is the one that introduced us and I wrote that in my how did we meet letter. (I was visiting him one day he forgot to log out of skype and his brother and mother called him, I thought his brother was cute he thought I was cute we started emailing etc.). I was expecting AP, the thing that has me worried is the CO telling him is file is being sent to the US, as she throws his passport at him. I have looked all over this site and I can't find anything on AP in the US. I am happy to wait out the AP if there is a good chance of approval after.

He was given a paper that said AP, why would they have given him that? I am so confused, could it be that they do AP in the US?
