Hi All,

I have filed I-130 for my wife and my application is pending and my priority date is Apr 2013. Country of changeability is India.

And we are expecting a baby in October and i am hoping the interview won't be scheduled before then.

Once the child is born how can add him/her to this application. I hope i don't need to file a new I-130 with a new priority date.

Once the child is born how can add him/her to this application petition.

To get the semantics out of the way, you filed a petition, not an application.

To answer your question, the child would qualify for a derivative visa. Here's the but, if you become a US Citizen, then you would have to file a petition for the child.

Thanks for the responses.

I called USCIS and the rep who attended the call told me i need to file a new petetion (I-130) when the baby is born and will have a new priority date !!

I am not sure whether that's correct.

When it comes to visas themselves, USCIS is not the agency to contact since they do not actually issue visas. As I previously stated, derivative beneficiaries are available for the visa category that you are currently in. When your priority date becomes current and you start dealing with the NVC, this would be the time to include the child.
