What else is new? If it's not DCF, it's an expedite. I don't think any normal filers are getting approved unless they've been transferred, and that isn't likely to happen to us for a long time....

So, my wife had an Info Pass appointment in Portland OR on November 8. Mainly, she wanted to see if she could put in for an expedite based on financial hardship. A bit of background:

I'm currently in Macau working part-time as I plan as I'm hoping to not be here much longer; I'd worked here for 7+ years when we decided to move back to the US. Organisations in my field in Macau are very reluctant to give me a short term contract in 2014 as it's widely known I'm in the process of immigrating to the US and they're concerned I won't see a contract out. I'm also having to pay rent in Macau and paying a premium for a month-to-month contract; the standard rental contract here is 2 years with 2 months deposit that you forfeit if you end the contract before the 2 years is up. Given the situation of not having any income in Macau, it's looking increasingly likely that my wife is going to have to start sending me money in the New Year for me to tread water until my IR-1 is issued.

My wife has a modest online business that just about covers essential expenses in the US and our savings are very limited. As wifey's business is online, the 'nice' lady at USCIS said she can up sticks and move to Macau, as you can do an online business anywhere, and wait it out in Macau until the IR-1 is issued. Never mind we have 2 kids in school in the US and we'd get raped in taxes as we can't claim overseas expenses on our business... USCIS lady reckoned we were unlikely to get expedited based on our situation. She also mentioned that processing times right now are longer and we can expect to wait 9-12 moths for approval. She did, however, say that cases are being transferred from NBC to other centres and to consider another Info Pass appointment once 6 months has passed on our application at the end of January. Basically, the experienced generally matched what I'd gleaned from VJ. If nothing else, the experience went to show just how useful VJ is...

BTW, the kids had a day off school and my wife had to take them to the Info Pass appointment with her. Didn't make a single bit of difference, and, although other VJ parents are aware our situations do not matter at all to USCIS, my wife said she told USCIS lady how hard this all this is on her and especially the kids. Wifey came away depressed at how nobody gives a $hit about the impact separation is having on your family...

So, the bottom line was tough titty if the process makes you broke financially, maybe things might get moving after 6 months but be prepared to slog it out for up to a year and USCIS couldn't give a rodent's backside about your kids...

But hey, what can you do? Sink into a deep black hole or crack on and try to get through the whole miserable experience...

It is a very sad idea that they could careless about our families, but I'm glad you posted this. I was planning to try and do an info pass as well but after reading this I know it would just be a waste if time and gas. My local office is also in Portland

I'm curious as to why you wouldn't provide what the instructions listed for the I-130, page 3 points D-J, which are all about proof of the relationship. That same information is not required for the I-129F ( other than the marriage certificate ) since an I-130 must be completed first.

We may know we love our spouses, but Immigration requires proof.

Beneficiary - Applying for CR1/IR1 (but also played the K3 card prior to understanding it may be phased out.)

2013: July 20: I-130 sent (Chicago lockbox)

July 24: I-130 NOA1

July 24: I-129F sent (Dallas Lockbox)

Aug 2: I-129F NOA1

Aug 12: Alien Registration Number was changed, I-129F.

2014: Jan 28/29/30: - 3 transfer notices for I-130 and I-129F.

Feb 3 - Hard copy arrived -Notice of transfer to Texas stating Jan 29th.

Feb 10 - NOA2

Feb 27 - email stating I-130 being sent to NVC from TSC.

March 6 -NVC received our case.

April 7 - CASE NUMBER yay! IIN and BIN obtained and email given.

April 9 - DS261 available and filled in online.

April 9 - AOS not yet payable but visible.

April 10 - email regarding NVC case number and access to DS261 received/ email regarding AOS received and paid.

April 11 - AOS sent by snail mail.

April 14 - AOS arrived per mail tracking.

April 15 - IV bill received via email, IV bill paid/ in process, IV package sent.

April 18 - IV bill showing paid/ DS-260 available and done!

I'm curious as to why you wouldn't provide what the instructions listed for the I-130, page 3 points D-J, which are all about proof of the relationship. That same information is not required for the I-129F ( other than the marriage certificate ) since an I-130 must be completed first.

We may know we love our spouses, but Immigration requires proof.

Here is a little background:

this is the second I-130 I'm filing.

the first one I filed was in 2006 for my ex.

i did not send any proofs also with that one and USCIS did not ask for any proofs.

I'm only asking the question this time because I'm divorced, I sent a copy of the divorce decree as required with the I-130 (divorce happened in the USA after 4 years of marriage).

There is nothing much you could do now. If they are happy with marriage certificate alone, and your are lucky, you will get approved. Else I believe they gonna send you an RFE asking for more evidence.

Since you didn't really answer i'll ask too: why didn't you provide it? And if you were convinced you shouldn't why ask now? I'm just curious. It didn't appear such a big effort to me and i thought it's better to be on the safe side. Just wondering why people decide not to.

Well, if an RFE doesn't come at the USCIS stage, i'd still attach the evidence to the NVC package so they have it before the interview. See, the thing with having an ex-wife also brought in on an immigrant visa by you - i think people (adjudicators) may start wondering what it is that makes you bring women over. So if i were you i'd try to mitigate it at an early stage. It's not like you can bring in another one and another one and another one and noone wlll ever start to wonder, you know?
