Nope. It can mean anything. From what I understand, when a file is moved from its current location in an office to another place in the same office, or if an officer accessed it for something including working on it, they need to scan it. And this scanning indicate touching.

I-130 sent to the Chicago lockbox July 20.

Priority/receipt date July 23

Notice date July 24

It shows our petition went to NBC at Overland Park, KS

My husband then sent in our I-129F the day that he had the NOA in hand (to the Dallas lockbox), so we'll get to test out the K3 theory:)

It went to NBC at Lee's Summit, MO.

And for those interested, was received July 30, and Notice date was Aug 2.

You saw my post on AILA NBC thread... MAYBE Division 8 IS operational already. We just don't know about it yet. We don't know about a lot of things here. So... there is hope.

It's unbelievable how many people are hurting here. What a horrible, horrible process this is..

hey, i would like to know from all July I-130 filers, USCIS is still transferring cases to NBC....anyone of you received a transfer letter?? this process started sometime in Aug 2012, want to know are they still continuing it or the respective service centers are working on I-130 files

Until one gets a transfer letter or USCIS Case status says " The I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN was transferred and is now being processed at a USCIS office. You will be notified by mail when a decision is made, or if the office needs something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.

please let me know has it happened with any of the July filers.

did not get transferee, I do not know if they still doing that!!!

My NOA1 hard copy says mine is at Overland Park, KS. My priority date is May 15, 2013. It is very possible that some of the early May filers were still sent to Lee's Summit, MO.

Hi Alaskafan,

My husband and I have given a thought to the same thing as I can visit on the visa waiver program. I'm thinking of going in Jan 2014 for about 3 months and seeing how that may work out. If it does, I'll come back to Canada and just shack up in a hotel for a few days and go back or hopefully have the interview by then. I probably have to quit my job to do this but I'm just really tired of being long distance at this point. Our priority date is Jul 22 and I'm hoping the July filers have it sorted by Feb or March...does anyone have any thoughts as to when we can see this all going through.

Does anyone have any thoughts on not having a job when you're waiting. My husband would be financially supporting me if I quit my job to go stay there for 3 months.

About multiple 90 day visits (which is my plan with my wife, and appears to be your plan with your husband): I've spoken with a lawyer about how long a foreign national must wait outside the US before returning for another 90-day visit. There are no clear rules about that, which is not to say that the US government does not care. Port of entry officials have discretionary authority to re-admit a foreign national or not, and their decisions cannot be appealed to a US court. So, I am hoping that if my wife goes back and stays with family for 30-45 days, the port of entry officials will deem that enough waiting time, before she comes back again. I've heard of some foreign nationals doing what you are planning to do - cross the border, hang out in a hotel, and come back for another 90 days. That may be less risky when you are coming from Canada, so maybe you can try it. If it doesn't work, perhaps you can put together a plan B, in the event, however unlikely, that a distrustful PoE official turns you back. In my case, the consequences of being turned back are too difficult, so we will just plan ahead that she'll stay over there for 30-45 days between 90 day visits, to play it safe.

I'm fairly sure that foreign nationals cannot work here if they are here under the visa waiver program. My wife has her own consulting business in her own country, which is fortunate. She can arrange her business matters to accommodate her visits here. But I expect to support us on my income, while she's visiting, and don't mind that at all, if it means that we can be together while we wait. Besides, she is taking the trouble to come, interrupt her business, and live with the uncertainty while our petition is in limbo. So, it is the least that I can do for her, to take away her financial concerns. Your husband probably feels the same, and if he can handle it, financially, even if it's a little tight for awhile, so be it.

The Nov 2012 article that you found does say that the facility will be operational in Dec 2013; the AILA notes from the May meeting with USCIS says end of Sept 2013. The article does give a reason why USCIS needed to open the facility: the new administration policy waiving deportation of minors of illegal alien families, if they file with USCIS. So that has created more paperwork for USCIS. Also, the new policy in the aftermath of the Supreme Court's DOMA ruling on 6/26 could possibly result in an uptick of I-130's over the short-term - many people who might have wanted to send an I-130 may be jumping together at the chance, now. Since USCIS won't talk about their workload and management decisions, it's impossible to know whether these things have had an impact at all, though the Nov 2012 article does cite the deportation waiver as a cause of increased workload. But how much? And what will the impact be of the enlarged staffing in Overland Park (800 employees vs. 300 at the Lee's Summit NBC facility)? We just don't know. And they don't want to talk about it.

With the start of the new month, we still haven't seen much movement in timelines. Crucial to me will be when we start to see on VJ that some May-August NOA1s are receiving NOA2's from Overland Park and the field offices, and how fast these NOA2s are coming.

Well, I am very glad that we can share advice and support on VJ. We're in the same boat, and we might all arrive into port more smoothly and swiftly if we continue to paddle together. Best of luck.

From what I have read on the VJ, and my experience working for an airine, the rule of thumb when it comes to visits to the USA on VWP is more time out of the US than in it.

I don't think your wife will have a problem coming in for 3 months on the first visit, given that she can prove ties to her country, but exiting the US for a month and then trying to enter for another 3 could be a problem. The CBP officer will see that she is trying to spend 6 months in the US and only 1 month in her home country.

I am not saying it can't be done, I'm sure it has be done before, just keep it in mind that second entry might be problematic. Your wife should be armed to the teeth with evidence of ties to her home country.
