my wife wants to go back to her country for good, but im afraid if she will be detained since her 90 days are up. We completed the aos pack but haven't sent it out yet. should i send the aos packet or buy her a ticket to fly back home as she wants?

She CAN'T leave the country yet! She needs at LEAST her advance parole card (travel permit) so you need to send her aos package first. Her k1 visa is valid just for 1 ENTRY and basically becomes invalid once she put a step in the US. If she leaves she CANT go back, unless you file a new petition in this case a CR1 visa (spouse visa) which is 7-11 month waiting.

why would you still do aos if she is leaving???

if she is gone for good, why sponsor ?

my bad i didnt read the part she was leaving for good! If she wants to go, dont send anything

If divorcing is what one of you (or both) wants, then do not file for AOS and have her go back home if that's what she wants.

If you think it can be resolved and that she's homesick, try to talk to each other and see if you guys want to continue your relationship or break up. AOS can wait, there's no deadline to file (even if it's best to do it early).

thanks well we don't want to divorce just she really misses home, shes been crying every single day for 4 months. she cant seem to make friends here for some reason, says things here make her nervous, and wants to live back in her country. so i tell her she can go and ill stay here and try to save money for some time and then go there to stay.

Then if her plan is not to live in the US, do not file for AOS. It will be a waste of money.

She seems homesick, and it's definitely difficult to adjust to another country. It takes time... Have you try to find some people from her country leaving in your area? It would help. :)

If she really think it's not going to be better with time and she wants to return live in her country, then she should go back...
